I am extremely confused by the news that the government is doing away with the i-130.. I don't fully understand what this MEANS. So I am looking to those who are little more in-the-know to help me out here:

Here goes--- My fiance is in the US military and he is stationed in Germany. In a few weeks, I am going to Germany to be with him. We will prompty be going up to Denmark and will be getting married (because it's simplier in Denmark).

Anyway, after we marry, I will become his dependent and will then be granted German Residency along with him. We were then planning on applying for DCF through the US Consulate in Frankfurt... and I would return to the States with him when his orders in Germany are up.

However, now I am totally confused. Is this even still possible for us? He just got home from a 14 month deployment in Iraq... and I am TERRIFIED that we waited all this time, and now we can't get married like we had planned.

Please help to clear this up and tell me where were stand! I'm *so* confused. What are our options now?

tammytoes! Take a breath! :)

The I-130 isn't going anywhwere--it is an important part of the US immigration process.

Fiance is still going to Germany, you're still getting married in Denmark (for ease) and going to live in Germany together!

About 6 months before you need to move back to the US, your husband will still petition you with I-130, and he will probably do it to the Frankfurt USCIS Field Office JUST as he would have in your plan.

You will apply for your visa and move to the US when it's time.

For you, nothing has changed. Keep a close eye on the website of the USCIS Field Office in Frankfurt, and the Immigrant Visa section of the Embassy's website to make sure no further changes blindside you.

Thank you SO much for the reassuring words! *phew phew phew* :)

So, is the reason we are not effected because we are filing through USCIS? I guess I just don't understand what makes our case different?

Yes, just as sophyie says.

Frankfurt has, and has always had, a USCIS Field Office.

The true "DCF" cases are I-130s filed with a Consular Officer by special permission of the USCIS. These cases are the ones that need to be readjudicated by a USCIS office now (when they were already filed/approved).

Consular Officers may not accept new I-130s at the moment.

I-130s that were filed at Field Offices have persumably been able to be adjudicated correctly because they were adjudicated by a CIS office and are not subject to recall.

USCIS Field Offices may continue to accept/adjudicate I-130s per usual. If you look, I think you will find that Ffurt has not changed what they are doing.

(funny, when I tried to explain this in the DCF Guide, it was too boring for people---guess it got interesting suddenly!)

The people most affected by this are USCs who live in the US but were previously allowed to file overseas.

People with I-130s filed after July 06 where the I-130 was filed to a Consular Officer and had not had a visa issued.

^ thank you so much!!

I cannot tell you how relieved I am. For about half an hour there my entire married life flashed before my eyes... but you managed to bring me back down to earth.

Thank you!

Even though it looks like my fiance and I will be okay, my heart still bleeds for those people who have had the rug pulled out from under them. How completely devastating.
