HI all,

We have my AOS interview on 13th March. We filed in 3rd week of december 06.

I was wondering what action if any is taken my USCIS regrading EAD at the day of the interview considering that I get stuck in namecheck or I am approved but no GC stamp.

Couple Scenarios after interview:

If approved - do they give EAD if requested stating that there is a good job offer that I dont wanna miss?

OR if approved - can we request GC stamp considering the job offer?

Although, the problem is that my EAD is still not out of the 90 days processing at the day of the AOS interview, and I have read before that all EAD related stuff is only handled by NBC and not local DO. ??

P.S. Just saw that my 485 and 130 were touched today..but, there was no touch for EAD....do you guys think that this touch was my AOS files reaching local DO for our interview???

AOS timeline - from F1 & wife (USC)

485,130,765 mailed - dec 18

applications on file - dec 21 (day 1)

check cashed - dec 23 (day 3)

NOA for 485,130 - dec 26 (day 6)

all three touched - dec 27 (day 7)

biometrics letter - dec 30 (day 10)

all three touched - jan 3 2007 (day 14)

all three touched - jan 5 2007 (day 16)

I-130 and I-765 touched - jan 10 2007 (day 21) - HUH? What about 485???

biometrics appt - jan 11 2007 (day 22) - DONE (went early - got done in 5 mins!!)

Interview Notice Date - jan 12 2007 (day 23)

I-485 and I-765 touched - jan 13 2007 (day 24)

I-485 and I-765 touched - jan 16 2007 (day 27)

Interview Notice in mail for March 13 - jan 19 2007 (day 30)

I-485 and I-130 touched - Feb 21 2007 (day 63) - huh? maybe files arrived at local DO

I-765 touched - Feb 27 2007 (day 69) - Thank you Lord!!!

I-765 touched and APPROVED - March 2 2007 (day 72) - Card Production Ordered!!!

Interview day - March 13 2007 - APPROVED!! took less than 15 mins!!!!!

Removal of conditions

I-751 filed - dec 10 2008

NOA1 - dec 20 2008

Biometrics - jan 21 2009

If you're not approved at the interview, you will most likely get your EAD around the 90 day mark. If you are approved, ask for the stamp so you can start work. If they refuse to give you the stamp, you might be stuck in a situation where your EAD isn't coming and your Green Card hasn't arrived yet, depending no how long it takes them to send the Green Card. Usually its quick, but sometimes (e.g. in my case) it can take a couple of months after approval at interview.

In many cases you may receive EAD prior to your interview, if that is the case the IO may ask for you to turn it in to them.

They asked my wife for hers and we " conveniently Forgot it" and left it at home so we could not give it to them.

The reason we did not bring it to the interview is because we had heard they sometimes ask for it.

she did not get her GC Card until Dec. 2 months after interview so having her EAD card allowed us to get other things done such as SS Card and alifornia Drivers Liscense.
