Hi! Im in k3 visa and we will just waiting for the NVC to

send our case to US embassy in manila, i have 1 son my question is does

my husband need to file I-130 for my son too? my husband only file one

I-130 for me is this going to be a problem that we dont file another I-130

for my son? hope to get an answer soon any help will truelly appricated.

The I-130 needs to be filed for all intending immigrants.

Only the beneficiaries of an approved I-130 can immigrate to the US. Your husband can file for your son, but your son will not be able to move to the US until the petition is approved and the visa granted.

I think she is talking about herself and the boy coming on K-3/K-4. If that is their plan, the I-130 for the boy can be filed in the US.

If the mother comes on an Immigrant Visa, the boy will have to wait for his own I-130+IV application and can not come to the US with the mother.

I think she is talking about herself and the boy coming on K-3/K-4. If that is their plan, the I-130 for the boy can be filed in the US.
