You should prepare your 2006's tax if you could. The more update and clearly information, the more earsier for her to pass the first round at the Vietnamese staff in the Consulate.

I know I should prepare them, but are they absolutely necessary? What is the cut-off date for tax dates? Reason I'm asking is I would have to apply for an ITIN for my wife, which seems silly since she will be receiving a social security number in another month or so.

It's not forced to submit them the 2006 tax as not all of people can have it yet. But if you have it, you should make a copy of what you have for year 2006, you don't need to make it certified copy or don't need to send them the original one, they will like to see the 2006 tax copy.

David used to bring to me the set of 2006 tax, he had to reply to the tax office with that documents, therefore I only could make a normal copy without certified to add to our document. When I went to the interview, they liked the 2006 tax and returned to me the 2005 tax's document although the 2006 tax was only a copy without certified.

I don't think your taxes would be finished in time. So I doubt they expect you to have them filed.

More important is that you do give your wife a 2006 W-2 and a most recent check stub would be nice too. That's what I gave to my wife because I had only received my W-2 the week before her interview. Besides, now that she has passed I will file jointly with her and get a tax exemption.

They will want some sort of 2006 tax documentation, since it is now 2007.

When my wife went for her interview...the person at the first window who checks the evidence, was not very keen to US tax documentation. He tried to tell my wife that she didn't have the proper 2006 tax documents. But she obviously had a copy of my 2006 W-2 and my last paycheck stub from 2006. I had already explained fully to her what this all meant. Thankfully the interviewer recognized this as well and the rest, as they say, was history.

It doesnot matter if you don't have the completed tax of 2006. I submitted to them the one they sent to David to ask him for reply, so this tax document was not finished yet.

But be careful with the tax form W-2, there is one case in our group was delayed due to the form W-2, it seems that was "kimi". You can re-check his previous articles and can read about his situation.

Well one difference is that "kimi" was doing a fiancee visa and "phong mai" is doing spouse visa like I did.

I think that if your W-2 has sufficient income you shouldn't have a problem with it as evidence.

I can only speak from my experience and that a 2006 W-2 alone was sufficient for my wife's interview. I also included the last paycheck stub of 2006, which has a summary of gross 2006 wages etc to further verify the 2006 W-2. Also included a copy of most recent paycheck stub from 2007 for proof of current employment.

She also had all my tax documents from 2005, but I think they disregarded those since it is now 2007.
