Hello,

I filed I130 for my spouse with Texas Service Center about a week ago. I didnt knew about this website then. So was not aware about the additional required documents for I130 for marriage based petitions. I just sent a copy of my marriage certificate and passport size photos. Actually we have been just married since couple of months so dont have joint-bank accounts and other documents mentioned in the instructions. We could have sworn affidavits of our relatives but anyways.

I know this has been asked sometimes on this forum, but has anybody seen any cases of additional request for documentation due to this requirement -- not sending all the supplemental proof for marriage.

Also I wanted to ask if this will in anyways affect my I129F petition. Will they delay the processing of K3 application based on non-submission of documents for I130. I am yet to submit my I129F and I saw that in the I129F petition they dont have this requirement to submit additional documents to prove a marriage. Is it recommended to submit the documents with I129F ? Any suggestions.

I am a little worried now after seeing some of the posts.. So just wanted to ask the forum.

2007-10-30 -- Got the K3 visa from Mumbai consulate !!

2008-01-21 -- POE

AOS/EAD Timeline

2008-02-22 -- Mailed I485 & EAD application to Chicago.

2008-02-25 -- packet received at chicago lockbox.

2008-02-29 -- NOA's for I485 and I-765.

2008-03-03 -- NOA's received in mail.

2008-03-11 -- Biometrics appointment NOA -- appointment date - 26th March.

2008-04-26, 2008-05-02 -- EAD card production ordered two email notices

2008-04-30 -- AOS Initial Interview notice - interview on June 25 2008.

2008-05-06 -- EAD approved notice !! after card production ordered :)

2008-05-07 -- EAD received in mail. SSN applied through local office.

2008-06-25 -- AOS interview at Durham USCIS office. Have to submit an updated I693.

2008-06-27 -- Hand delivered I693 to Durham office. Got the approval on conditional green card :)

You may possibly experience some delays in application processing. Read the Guides in the tab above to find more information regarding documents required for filing. For the new form I-130, they require additional support documents to prove your bona fide relationship.

Because you are married, you have to include a copy of your marriage certificate since you are persuing a k-3 visa as well I presume. And, you need to submit form n-325a. One for you, and one for you wife. They both need to be signed. Everything is on the instruction of the forms. Make sure you read it thoroughly or you'll be expecting R.F.E (Request for Evidence) which may delay your application further.

I spent all night reading all the guides, and the instruction with the forms. I, as of yet, remain un-file because I'm awaiting my wife passport pictures from Cambodia to file with form I-130. We have been married since January 30, 2007.

Hello,

I have not yet witnessed anyone on VJ receiving an RFE (request for evidence) based on question number 7. It is a suggestion, and hopefully in the cases of new marriages they will understand it's difficult to provide proof of an ongoing marriage when you live in different countries, although some of the items are easier of course.

12/25/06 - DS3032 & AOS Fee Bill Mailed (phone system updated 12/27)

12/27/06 - emailed choice of agent; 12/29/06 - received email from NVC confirming choice of agent!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

Michael's K-3:

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal
