Working From Home

Hi All,

I have just gone through teh medical process and currently waiting an intervie date.

Obviously my employer knows my plans to move and is willing to keep me on a UK contract but allow me to work from home for my first two months in the US. This would allow time for us to submit all our forms and get married before my income effectively stops The aim is to limit the amount of time between the end of my employement for my current employer before being able to apply for a role in the US

As I would still be on a UK contract and being paid in to my UK account is this ok legally to continue to work from home even though I wont have a work permit in the US and that is where I will be

Interesting question that has both immigration concerns as well as tax concerns. You may want to do a google search about this specifically. I did a quick one and found a helpful outside link from an immigration attorney, but their only answer was that "it depends".

According to the USCIS site you can file an I765 as soon as you enter on your K1, but it is only valid for 90 days, however I believe it can be extended once you file the AOS package. Regardless, it sounds like you would be in a very grey area with regard to immigration law, and who knows with regard to tax law.
