K-1 Visa acceptanance has expired

Timeline

I have a friend who did not pass the medical. They found that she had a rare version of TB. She takes pills everyday and a shot in the arm 6 days a week and she has to take them for 16 weeks. Then, she was told, that she would have to wait 2 more weeks and do St. Lukes again. I understand that my friend will have to pay for the new medical.

My question is, she isn't even half way done with her treatment and the K-1 acceptance date has been past. Does my friend need to start completely over with a new I-219f? Or is the old petition on "hold" because she is still under the Dr's care at St. Lukes.

No issue with the petition validity, the embassy will extend that for up to a year automatically. Right now it's on hold till then. She does nothing for now. Edited by Greenbaum

ya, when under medical guidance as a result of the SLEC exam,

the validity of the duration printed in the petition approval

is extended by the IV Unit.

Although they DO know about it, it never hurts to check in, remind the IV unit that both of you are still seeking to have a K-1 visa interview.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I miss quoted my friend, the treatment is 16 months, not 16 weeks. And then she has to wait for 2 more months before she can try St. Lukes again. I think the answer is the same - that the petition is on "Hold" until medical is done.

ya, at 16 months of treatment,

friend will need :

1. new medical exam

2. new police clearance report (NBI?)

3. another CFO interview (usually these are done after visa approval but some Pinays get it done earlier)

i've heard/read of these long times here at VJ - maybe use the advanced search tool on 'sputum months' and see what comes back.

The embassy will extend the validity of the petition, I know of one other case that went beyond the year and there were no issues, and yes they did have to pay a new visa fee but other than that it was business as usual preparing for the interview. Do have your friend contact the embassy on this, even though I am pretty sure SLEC has notified them.

Thank goodness the TB was found and is treatable!
