Timeline

After we received NOA2 and an NVC case number, my husband moved to a new apartment. My case is already at the consulate with an interview scheduled in less than a month (woo hoo!)

Question:

Do we need to file a change of address with USCIS? There is no petition in process right now, but we will be submitting a copy of the approved I-130 when we submit paperwork for AOS and it shows the old address.

AOS & EAD Timeline

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

I don't think you'll need to contact USCIS about this, as long as the consulate knows now, USCIS doesn't need to know until you file AOS.

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

Thanks for the input!

The address that the consulate has for him is the current address (I put down in my DS-230 Part one and the DS-156 that I will be bringing in person). None of the paperwork that the consulate gave me has his address, just mine and my case number. I never filed any sort of change of address for him since they don't have his address listed anywhere except in my case file with the original filed petitions. Should I tell them or is it a moot point?

Also, when we file for AOS, we just use his present address and not have to worry about his old one, correct?

You need to keep the Consulate posted. I think they even state that in Packet 3 ... "notify us of address changes." Even if you notified USCIS, they probably wouldn't update your file since it is now with NVC & Dept. of State. My experience is that USCIS is not very good at address updating anyway.

And yes, I think just filing the AOS with the new address should be fine.

Yup, it's not my address that changed (I'm the beneficiary), it was the petitioner who moved (my husband, the USC). He moved after the case was already at the consulate.

Thanks for the good luck. I'm sure I'll be a nervous wreck before I leave for the consulate and will be posting asking for good luck in the Canada forum. :)
