what need an affidavit of temporary guardianship or just an authorization-where need to notarize?

Hello Everyone,

I need an advice please help me what the right process I going to do, my sons cr2 cases still pending at NVC due to the passed computer system technical trouble, according to the lawyer who process my cr1 visa case at the same time my sons cr2 visa cases, I have no enough time to wait for my sons visa to be done my cr1 visa will be expired, so my hubby and I decide to leave my sons in the custody of my elder brother until their visa will done and follow me in the US, also who assist them for their medical examination and their visa interview at USEM, do I need to prepare an Affidavit of temporary custody/ guardianship or just an authorization to brother, where I to go to notarize? someone told me its need to notarize at US Embassy Manila because its an document use for visa interview this is true? thanks very much in advance for any reply for this matter. have a bless day to all.

You don't need to issue anything. If your children are minors, their uncle can simply accompany them to SLEC, USEM and CFO.

USEM and St. Lukes won't need anything issued from you. It is however different with the CFO. You need to issue a letter of authorization to the legal guardian allowing your minor children to be registered at CFO, it must be supported with an SPA too. If your children is not travelling and will be accompanied by somebody else, they'll need a travel clearance from the DSWD.

if somebody else is traveling with the child to the US other than you or your husband, then yes..you have to have a travel clearance. Best is to go to at your local DSWD to get more information about travel clearance especially the requirements. They have some listed in their website but there are specific documents sometimes that the local DSWD is asking than that listed in the website.

FYI: I assume based on your previous question that you are still in the Philippines? If you are, try to execute an SPA making your brother as your child's legal guardian. He will need it at the CFO together with your notarized authorization letter

A Filipino minor traveling from the Philippines to a foreign country accompanied by a person other than his or her parents.

Who does not need a DSWD Travel Clearance to leave the Philippines?

• A Filipino minor traveling with either parent, with his or her solo parent or legal guardian;

• A Filipino minor whose parents are in the Foreign Service

• A Filipino minor who holds a temporary or permanent resident visa of another country and is rejoining the parents in that country

• A child holding a foreign passport

This way of travel was decuss to me of my hubby he will get airplane tickets with an additional pay for an airline personnel who will assest to my childrens to go to in the US safely.

Yes, you are correct in saying that there are so many inconsistently's causing one to run out and get enough paperwork to cover every situation causing OVERKILL. I recommend do was normal and cover some of your bases. You will never know what each and everyone will ask for as you travel out of the Phil.

yes I still here in philippines i just get my cr1 visa today where i go to execute SPA I live in caloocan do i go to court in my place, my husband also told me to get legal document about temporary guardianship of my brother to my children and bring with me to be all legal its really needed?

Here are examples of the forms you will need. Re-type in word changing the reference to Los Angeles to blank and amend with who will have guardianship. Get the document notarized and have copies made. Two copies of each should do it.
