Bad Credit

If you have outstanding IRS tax due, financial litigation, or convicted fraud charges

(like using bad/stolen checks/credit cards), then it could be a problem.

But otherwise, just bad credit score shouldn't cause too much trouble.

However, are you making enough (around $20,000 a year if its just 2 of you)

to sponsor him?

No IRS tax due, no convicted fraud charges.

What does financial litigation mean?

I haven't paid a single penny from my debts since 2013. I am starting now, just signed up for credit karma and called all my debtors and made payment arrangements, but since it's too much, i have made arrangements to pay $50 per month. I know it will not be paid in a year since i owe like $3000 from 4 credit cards.

when i filed for income tax this year, my annual was $30,000. I'm guessing this year should be more since I have a part time job.

Will i be able to adjust my soon to be husband's status from being an overstayer to permanent resident?

I can only speak on the credit part- it's not mentioned at all during the process. I have bad credit mostly due to school and 1 credit card and it was never mentioned. I don't believe it will affect you as you make enough to do the affidavit of support.

Your BF's overstaying may cause conflict in his getting AoS.

How?

He came to US with work visa. He's eligible for AoS, i think, he'll be an immediate USC relative. I have read and asked opinions of lawyers online, like AVVO.

credit history has nothing to do with becoming a us citizen

I know it has nothing to do with Naturalization. My question was, If I were to marry my OVERSTAYER boyfriend/fiance (he came in legally but he can't maintain his nonimmigrant status) and filed for AoS, will my really really bad credit result for denial of AoS?

The screenshot is from uscis website saying that my overstayer boyfriend is eligible to file for AoS if he's a spouse of a USC.

...I'm hoping to be citizen next year and we'll marry after I'm officially a USC.

Credit has nothing to do with process at all, it can be worse in the country and you will be fine. But like someone said owing taxes will be bad. You should have no problems with AOS for over stay. You could file bankruptcy during the process and it will not hurt the paperwork. I suggest you do something like that because having bad credit just causes more and more problems and higher charges down the road. The quicker you change the sooner you can get decent interest on a house and things like that.

Never file bankruptcy for that small of a debt.

I agree didn't see the total amount. I know someone who filed bankruptcy with $7000 of debt, I couldn't understand why. $3000 is like a part time job for a month or two, I'd get that paid off quick. The car repossession will hurt for about 2 years, but that could change. Home foreclosure is the worst, if you fix your credit you should be able to buy a house quickly though. Credit is easy to fix it just takes work. When I was younger I was bad with my credit cards and didn't care about paying on time, I negotiated my final payment with them removing the late pays from my credit report. The best scenario is not needing credit though, that's when you can really get tough with them. When you can afford to pay everything in cash, then you can tell them to jump off a cliff if they do something that isn't fair like weird charges. Or even not do a refi if the mortgage interest rates have come down. Good luck OP, don't get stressed out about it, take control of it.
