Great .. Request for initial evidence . Is that the same as an RFE ? Cus I know last time I called I was told there is request for evidence and request for initial evidence but I don't remember the difference

I'm so drained . This is the 3rd RFE. My only hope is that at least they aren't denying it

There is a request for initial evidence and a request for additional evidence. (both are RFEs) In the case of a request for additional evidence, you have met the basic requirements of the application; however, USCIS requires further information in order to make a determination. Initial RFE reset your 90 day clock for EAD, additional RFEs only pause it.

Did your sponsor make the required income for: themselves, the petitioner, the beneficiary and anyone they claimed on their tax return as a dependent?

Hey , the first 1 was requesting more evidence that my mom made enough

The second one was telling me to find a different joint sponsor

So we got my aunt who makes 60,000 a year. I checked online and that's enough to support more than 8 people . She has NO dependents so it was only herself and my husband she's supporting. I followed the instructions best I could. I'm pretty drained by this that keeps holding us back ...

I think I'm going to wait to receive it and if it's difficult or something I'm not sure about , I'll be calling an attorney . I want no more RFE .

I haven't even told my husband because he's sad at this point . I don't want to further his guilt of not providing for our family

sorry for your 3d RFE.

Hope you will fix it soon. I have a question thou. After you mailed back the RFE, how long does it take them to update the case status that they received the packet.

I always mail it express so they get it the next day . And writhing 3-4 days my status changes to received

yeah, I also mail it express and they received it on Monday. Hence, I was wondering if they update status on "received" or just let it hang as it is.

Thanks, I'm terrified about my RFE as well owing the fact that I mailed it back in 1,5 months after received the request

Hey bonzaigirl!

It looks like I'm in the same boat as you and Pishi Pishi. My paperwork was received on July 28th and I still have not gotten my biometrics appointment letter in the mail. I called the first time after 30 days and a service request was done for me. I used my I-485 receipt number. Does that matter?

Anyway, I got a letter in the mail (in reply to my service request) a few days later pretty much telling me to continue to wait. So I waited and then called again near the end of September. I spoke to a Tier 2 agent (I believe) and she told me to call back if I had not received anything in the mail by October 4. So I called this morning and spoke with a lady who asked me to read the service request letter to her. Then she told me to wait (I was vexed). I called again a few minutes later and spoke with a nicer lady. This time I used my I-765 receipt number and she placed a service request for me. Should I have done that? Or used my I-485 number again? .

Oh dear. We do are in the same boat. Am not sure, maybe it would be better to call them regarding the I485 and EAD receipt number. Although when I called them before, I also asked if I should make another service request for the EAD and AP as well, and they told me that when they send out Biometrics it's for both.

I just checked my USCIS and still it it says that my second service request still hasn't been assigned for processing. But both my AP and EAD had been approved last Monday.

Oh wow! That's amazing. I can only hope and pray that the same thing happens for me. Also, I just checked the status on my service request for the EAD and it was completed this morning. I guess I just have to wait and see the results in the mail.

EAD and AP were approved today. RFE response was received on 8/21, so it took about 6 and a half weeks. So for those waiting after an RFE response, 6-7 weeks may be a good time period to expect an EAD/AP update.

Just wanted to ask, is it possible to get an AP/EAD approval first then get an RFE for the AOS later?

I'm not waiting for EAD and AP because I didn't apply those. But, it's been 5 weeks for me. I'm hoping to hear from the USCIS about the interview soon in the coming week. Hopefully, 6 or 7 weeks is maximum time.

AOS generally takes much longer than EAD and AP. I still have heard nothing about AOS. Some people on here seemed to have gotten lucky and received interviews already, but I think they're more exceptions than the rule.

EAD and AP seem more uniform and easier to predict, from what I've seen on here. 6-7 weeks seems about right. For AOS, it seems to range anywhere from 1 months to 9 months (maybe longer?).

Thanks for your input. I guess you're right. I just hope It won't take 9 months, because that's when my H1B expires. It'll just get more complicated.
