Hi all,

I just got my RFE mail now and so pissed off.

They are requesting for another joint sponsor that the one i submitted didn't meet up cos of his household size.

I didn't just get what d crazy officer wanted cos my sponsor income is $63,420 and his household size is 6 including himself.

Meanwhile the 2015 HHS Poverty Guidelines states that for household of 6, the 125% is $40,712.

Pls can someone help me understand this cos its really getting at me right now and so mad....lolz

The form was probably just filled out incorrectly. I am sure it's an easy fix. If your co sponsor does make that much then it's not about meeting the poverty line.

Your co sponsor family size is 6 w/ his sponsorship it would be 7. Perhaps that's all that's wrong.

Generally waiting time for AP and EAD is 2 months, even if you sneak a peek at June 2015 AOS filers majority got approved for that in around 2 months time. So techicly there's only 2-3 weeks left to wait if they stay on schedule! Cheer up! You are almost there!

I just figured it out.

I didn't send in my co sponsor's W-2s for all the tax returns for the 3 years I sent.

Yes, you can use the same co-sponsor.

Make sure that the second afidavit of support is complete because it will lead to a denial if it's not. (No pressure!)

For the I864 you only need the tax documents for last year, 2014. Make sure you include EVERYTHING. Any tax document that he reports on must be included. Such as IRA's, Student Interest, Homeowners, etc etc. Sending just his W2's is not enough if he is also claiming student loans, mortgage interest and if he withdrew from his IRA (1099). All, can't stress that enough, all supporting docs for his 2014 return must be included.

You do need to state the income amount for previous years but no tax documents are required.

Yes, it sounds like you're back on track.

When they send out the RFE they state the specifics on what's missing. They have to mark/flag/close the case internally and marking it that joint sponsor doesn't meete guidelines was probably the closest thing.

Make sure you have mail them the following:

Tax Return for past 3 years (Form 2014, any Form 1099 your co-sponsor might have)

W-2 Form from past 3 years

Pay Stub: last 3 pay stub from your co-sponsor

Do a math here, if your co-sponsor has any type of loans they might consider to take it out from the income, a little tricky.

Make an InfoPass if you are not sure, wish you good luck!

Make sure you have mail them the following:

The only requirement is the most recent tax year documentation.

I agree, and I said MIGHT, this is heard from my attorney which do not make sense to me at all.

For safety and we do not want to take any risks, we sent 1040 with 3 years back which shows the past and paystub shows the current, include W-2 just in case.

mymercy replied with required documentation, but we did an extra, nothing wrong with it.

You're correct, you can send the information for the past years, but it's not a requirement, as it states.

The only time loans are looked at is when they're associated with assets. In the event that a sponsor is using assets to show fincancial ability AND the asset has a lien, would it then be necessary to show financial proof. However, in the OP's case this doesn't apply.

Only 1 year latest (year) of IRS tax return is required. You may submit tax returns for 3 years but only 1 latest year is required.
