So today was a disappointment.

I got to the Montreal consulate, was called to the first window and, among other things, the officer asked if this was the first marriage for either of us. I stated it was my first, but my husband's second. She then asked for the original copies of his divorce decree, which I did not have!

We had submitted a copy of this when we filed the I-130 and once we received our NOA2 and sent all our other forms and supporting documents to the NVC, we did not send it again. The NVC accepted this packet and did not send any sort of RFE. Then when I received my interview letter from the NVC with the required visa interview documents listed, the marriage termination documents were not listed as required!

So then I get called up to be interviewed and the interview was really easy, everything was stamped as approved, but because I did not have this divorce decree, my case is now in AP and will not be completed until I send in the original decree. The officer said everything else is good and I can be very confident my application will be approved, but this delay could mean another 6-8 week wait.

I am beyond frustrated and upset!

Another frustration is that they kept my passport and my current job requires that I travel to the US once a month. This wasn't going to be an issue, but now that I cannot travel for work in August, I won't be able to keep my job.

You should be able to contact the consulate and they should be able to provide it to you. With a work explanation they should have no problems with. I have seen this mentioned in other places on Vj. Can not hurt to try.

I was in the same situation with regard to my US husbands divorce papers. The interviewer gave me my passport back and told me to send it in with the divorce documents, which I did the day after I got back from Montreal. Then I get a letter "MAILED" to me letting me know they required another police check as the one I gave them expired (while we were in AP)

Long story short, I got the email tonight letting me know my passport and documents have been picked up by Loomis

Interview was May 20, and then the systems were down for a couple of weeks, so I think they got our visa through the system rather quickly considering everything.

There's a wiki topic here at VJ, constantly updated for current process,

on NVC Doc Intake and processing,

and the divorce decree on the petitioner is listed.

If you not see it, study it, made it yer new bible during NVC doc intake, well, I'm sorry about it.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

So sorry yesterday was a downer for you but hang in there. You are the third person in a month that I have met on VJ having that identical missing document for MTL interview.. Makes you want to scream especially after the trauma of NVC!! The good news though is that two of those persons had quick turn arounds once the divorce papers got to MTL. i THINK YOU'LL BE IN GOOD SHAPE. Just get it to them as QUICKLY as possible. My hubby is still waiting but in our case two days before my hubby's interview we receive an email from MTL saying they NEEDED his original Jamaican Police certificate.. (He's a naturalized Canadian citizen and left Jamaica 40 years ago!!! OK so it's almost a two week process and we have 2 days!! So to the interview he went ON 5/5. Was given the 221g and his status changed to AP However the CO gave him back his passport just in case he needed to travel to Jamaica to get the PC.n . We provided the missing PC .It was DELIVERED ON 5/19 BUT THEIR DATE FOR RECEIVING IS 5/29...( ok SO WHAT'S 10 days ??!!

6/2 Status changed to READY!! Excitement in the air thinking ISSUED next.... Wishing and hoping wishing and hoping... Updated 6/4,6/8.. still Ready.. Now Technical Issues .. Updated 6/16... Technical issues resolved 6/25 no update still READY.... :(

Latest communication from my inquiry file being reviewed!! Really seriously????? I think his file is at the bottom of a pile because nothing else is making sense. Anyway hang in there. I believe you can request getting back your passsport
