My advice is that always be truthful with the CO.

That being said when you say your wife is living with you - are you the petitioner or beneficiary? If the petitioner is living outside of the US for more than 6 months then they may ask you for domicile proof.

Same case is with my friend...his wife(petitioner) is living with him and go to US in every 4 to 5 months. Live in US for one month or made and came back. His date is current.

What you advised him that how he should response. Now he has a baby girl as well and added as accompany into current petition...

Any advice will be helpful for him... Thanks :)

I would be truthful and say just that you have been visiting frequently as you want to be with your spouse. They may ask about financial support. If you have a joint sponsor then there shouldn't be any issue. But if the petitioner is the primary sponsor it may raise a red flag unless the petitioners work allows them to work remotely from anywhere in the world. Hope it helps

Very logical. Yes, his father is law the sponsor as he is already a US national... As she is not doing any job and waiting to all settler in US and then start her career and new life with spouse and daughter. he just told me that he had provided his US living address as his father in law home address and same place of residence of his wife as well.

hope things will be good!

Thanks for your expert Advise. Cheers!

Several months ago, I pointed this out in discussion but other members talk me down so I kinda left it out. Domicile can be problem. Can you give history of how long your wife stayed in the US and your country in past 2 years. where does your spouse live? What is her adress? What job she do? That kinda question will be asked not what is her us adress?

Domicile means living and working majority in the US for immigration purposes. Typically yes after 6 months of being outside you need to prove domicile to immigration officers. There are certain exceptions where you can be outside for more than 6 months and still maintain domicile. For example if you are working for the US govt outside of the US you can still claim US domicile. I've been out of the US for at least 4 months as my father was ill during our process and had no issues with domicile becauSe my work, car, accounts were still all functional and working in the US. You are also allowed to be outside of tHE US if you are studying outside and cannot be back until after coursework is complete. after 6 months of being out of the US and if you have no job or strong ties, typically they ask to see proof of domicile basically - the intent to settle in America. So it could be opening new bank accounts, signing a lease, employment offer letter etc.

Just be confident at interview buddy and reherse interview questions so that you can answer. If problem happen, you can show intent to restablish domicile by providing return tickets. I will pray that all goes well for you and you get your visa.

Congrats on your approval. I'm not sure about Nepal but in London, they said it can take up to 2 weeks to receive the passport back after the interview. Though generally it's been taking between 7-12 days. Also Monday was a US holiday (labor day) so the embassy was closed
