Hi guys:

I need some serious advice for my girlfriend. Please help if you can.

She has been married for over two years now (August 2004) and her conditional green card runs out in July 2007. Her husband told her he will not sign the papers to get her permanent alien resident card. He told her he can and will get her deported. They have always lived together but they have no children.

Can he do that? Is there anything she can do to stop him from doing that? She is from Germany and her mother lives here too but is also a green card holder. Her step father is a US citizen could he take over as a sponsor?

I just met her a few days ago and she is so terrified of not knowing if she has any rights or what could possibly happen to her.

If she can prove that the marriage was entered into in good faith, she can file to remove conditions on her own:

As long as her marriage was valid like JenT said then she can apply to lift the conditions on her greencard herself, she doesn't need her spouse.
