Hi,

I was just wondering how most of you packaged all your information to send. What I mean is, I purchase a thin binder and I was going to put all the papers and proof and label everything. Will this be acceptable?

I was also reading that someone mentioned about overstaying their visitor visa and when they applied for the K-1 they told of this occurance and they didn't have any problem getting everything passed. If anyone has had to put this same sort of information regarding overstaying a visa on the K-1, I would love to hear about it. Also, if you could include how long you overstayed and what red flags this may have triggered in the process and how you handled them.

I packages everything in a nice binder, in organized sections with a cover detailing the sections and what was in those sections, clearly labled and all of the information in slip sheets for easy removal. however you do it make sure it is easy to find stuff and not a clustered mess.

Contents include:

- Payment in the amount of $ 170.

- I-129F

- G-325A (Petitioner)

- G-325A (Beneficiary)

- Birth certificate (Petitioner)

- Evidence of having met in person in the past two years

- Original statements of intent to marry. (Petitioner and Beneficiary)

- copies of prior divorces (Petitioner)

- passport style photo (Beneficiary)

- passport style photo (Petitioner)

A previous overstay on a visitor visa does not affect the initial I-129F petition. It comes an issue at the interview.

If the overstay was less than 180 days, no waiver is necessary. Over 180 days, waiver and hardship letter proving extreme hardship to the USC if the visa is ultimately denied and the USC has to relocate permanently to the fiance's country is required.

(i) In general.-Any alien (other than an alien lawfully admitted for permanent residence) who-

In preparing your packet, please take note of the following:

a. Do not use binders or folders that cannot be easily disassembled

you are quite right. I was not clear. I used the type of binder they were looking for with the proper fasteners. I believe what they are trying to avoid here is bulky binders of the three ring variety. Mine easily fit in a next day envelope and was only about 1/2 inch think.

I disagree. I believe they'll disassemble the binder and pitch it, so that they can put the papers in the order they want. You'll be able to see your file once you get to the AOS interview stage. All our original paperwork was in a different order than we submitted it, in a manila folder.

So you can see the initial K-1 file again @ the AOS interview? (Or did I understand this wrong) Wow, I didn't know that...

could very well be true. I hope one day to get to that point. I'm glad to learn something. I know my initial thoughts when putting it together were that they would loose something and i would have to resend it costing more time.

So you see the initial K-1 file again? Wow, I didn't know that!

You see it on the interviewer's desk. Depending on how much evidence you've submitted, it can get pretty thick. You don't actually get to thumb through it yourself, but if you're sneaking, you can kinda glance at it as she's leafing through :lol:
