I have read so many people with this same dilemma and I reached out to my contact at my senators office to question her about it. This was her response:

If the interviewing officer denies the visa, the case file is then sent back to USCIS as a consular return. USCIS will review the application again and decide to uphold the Consulates denial or send back for an additional interview. You are welcome to file a complaint with the Office of the Inspector General within the Department of State by using this link: https://oig.state.gov/hotline

So by all means everyone report these co's!

This is good to know. I too have contacted my senator. I also wrote a formal complaint against the CO that denied him and sent it to https://oig.state.gov/hotline. I am not going to stop making noise until my husband is here with me!

Update on my case.

If you guys remember, I contacted my senator the same day my wife's visa was denied. I sent him an email describing everything that took place during the interview along with most of the evidence myself wife took. His office then forwarded my email to the chief consulate in accra.

1. The chief consulate review my case and stopped the case from being sent back to the U.s.

2. It was placed on administrative processing.

3. 2 days ago I got an email which stated that the case is being investigated and should be completed in the near future.

4. They said after the review is completed they will call my wife to come back to the embassy.

So my case went from being put in the mail to go back to the u.s, to my wife being called to come back to the embassy.

When I got the news that my wife was denied I had a calculus-2 exam that day. I was completely depressed and couldn't even focus on the exam. I just knew I had to take action and can't just sit around and be sad. I honestly did not believe anything would come out of contacting my senator, I was just sad and needed to do something. And thank God I did. I thank God I did. Even if they just call her to bring more evidence at least this time she will take two luggage bags of evidence. It's much better than the alternative.

That's great that you went into action immediately before they send it back, there is always a glimmer of hope when it's still at the embassy.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

My wife had the same rude lady KM she didn't like the photos of us with her family. She wanted photos of me and my wife. fiancé at the time of us kissing and not on the cheeks because my wife was kissing me on the cheek and she said you can kiss anybody On tha cheeks. She won't more photos. And more Conversations. And we did on our second interview We waited for hours And when we went up to the window. She threw all the evidence in my wife's face like a dog Fiancé at the time And she said I see your relationship is not real and that was it And we went and got married the next day and start filing for Cr-1. Somethings got to be done about this Lady and that black lady to she's even worse and her name is Alma Gurski. I sent my letter of complaint and evidence to the Inspector General. And to my senator and conversation. To try to get these ladies removed Because their unprofessional and rude. And keeping us from our love ones. And denying us visas just because how they feel. And not because of the evidence Everyone please let's keep the heat on until our love ones r home.

Mr. James you are right about those two ladies at that particular embassy. I hope something can be done about it? Is very bad behavior from them because everybody is talking about them. I know more than 6 people who are not on this platform saying KM is very rude.

Lets join hands and smoke them out from that embassy...

Unfortunately no lawyer can get you out of AP, you have to wait until it's complete. If it lasts years then a lawyer can do a writ mandamus, which

is forcing a decision but this can back fire because they will deny if their investigations aren't complete and at the next filing you go through it all

over again. All you can do is have the senator/congressman make inquiries. Our case was denied shortly after the senator inquired after almost

17 months of AP. It seemed to tick the CO off unless it was just a coincident.

I first googled her when I left Ghana last year, and I saw things about her, and when I report I'm gonna write a detailed letter from my lawyer to DOS and make sure someone is listening! I've only complained on KM wish someone knew her name she probably has things about her also!

res00np5 Do you know any lawyer or heard of any good immigration lawyer who have had experience in dealing with AP cases?
