Is anyone else experiencing a really long wait for the AOS?

We submitted the I-485 along with I-765 back in February, had biometrics on 12th March and got my work card at the end of April.

That meant the I-765 was fine but we got a RFE for the AOS (USCIS had lost some documents in our package, so our lawyer sent them again) and they sent us receipt of this on 9th April.

I called them on 8th June (The date we were supposed to have heard something by) and got nothing out of them apart from that we have just to wait.

Then a week ago I got a letter saying that this is a potential waiver case but that they are currently six months behind so I should expect to hear something by the end of the year with that timescale.

Has anyone else received this letter? Really pissed off at the amount of time this is taking. I assume that conditional permanent residency is backdated to when I entered the US, or our marriage date at least?

It is not 6 months, that timeline is to calm you down. Everyone is waiting at least 8 months and up. My sister has been waiting from July 2014.

Sorry but conditional GC counts from the day they approve it.

What a mess. The only thing I couldn't understand with the delay is that they obviously looked at it pretty quickly to determine they needed an RFE, which was dated 25th March, only five weeks after initial NOA. What's really irritating is that I would have had interview and GC already if they hadn't lost some of our documents.

That's a bummer about GC counting from the date of approval, so it's basically two years condition plus the time it takes from arriving in the US to them getting round to processing it I guess...

Sorry to hear about your sister waiting this long, must be a nightmare. Hopefully USCIS get their act together soon. It's a joke that that you can potentially be here three years before having the condition removed.

Yep, NOA for both I485 and 785 were received on 17th February 2015. Biometrics on 12th March and EAD approved on 23rd April. We were sent an RFE on 25th March after they lost some of our documents and now we seem to be stuck in this backlog, it's a shambles.

If you have received NPIW, like Nancy mentioned on previous post, there is a very long thread especially dedicated to whom fall into NPIW club. If you follow the thread then you will find many shocking stories regarding NPIW. For instance, some people got RFE before biometric and after waited long period of time they have received NPIW and unbelievable that one of VJ members had to go for the interview at TWICE.

Yeah I've had a look at it, the medical expiry thing is unreal. Part of me is thinking the only reason they processed my case so quickly is because I had another full medical done here, only for them to lose documents.

The most annoying thing is that we can't go home until the GC comes through, was hoping to go in October/November and February but now that's up in the air. This makes the whole process of getting a K1 visa seem easy in comparison!

The most annoying thing is that we can't go home until the GC comes through, was hoping to go in October/November and February but now that's up in the air. This makes the whole process of getting a K1 visa seem easy in comparison!

It is not guarantee. There is another VJ member included her I-693 done in the US along with her AoS package but she got RFE to redo her medical again after waited so long. Her name is Vivian on NPIW thread.

You can apply for AP (travel document) while AOS is processing. Did you apply for the EAD? Normally they would be applied for together (both free when adjusting from K-1) and would arrive on a combo card. No reason you can't get AP and visit back home.

You can apply for AP (travel document) while AOS is processing. Did you apply for the EAD? Normally they would be applied for together (both free when adjusting from K-1) and would arrive on a combo card. No reason you can't get AP and visit back home.

I didn't apply for AP since I didn't expect AOS to take this long but have my NOA-1 with according to Girl from Celebes means they will waive the fee when I do apply which is handy!

How do you feel about this? Is it frustrating? I pretty much told my fiancee that she can come and relax and just work on English and getting acclimated to the US for the first year. I don't want her feeling stress about getting a greencard. What worries me is how she can get a license to drive while waiting.

My then-fiancé ( my now husband) filed I-129F after five-year of our relationship. So, waiting green card to get approved is nothing compare our long distance relationship. My husband says as long as he has me here that's fine. The problem is that we will move to another state very soon and there are a lot things need to be done. Changing address is easy but we don't know yet which city we will settle in.

Once your fiancee has her Employment Authorisation she can then apply for a social number. Once you have that she can then apply for a driving licence.

When I went to obtain a licence when I got here, I was told I couldn't because I needed a social number.

However, I can drive here for up to a year on my UK licence, provided I carry my passport in the car along with my UK licence, so don't sweat, I'm sure the requirement is the same for other countries as well.
