Im having the same problem. I applied for AOS together with the I-765 and I-131. I just received an rfe for the I-765 and I-131 saying that my name on the application is not the same with my name on the other USCIS record which I assume is the k1 application. They listed the things i need to submit, birth certificate, passport, visa, and or national ID, and I am 100% sure that ive sent those already since I have the exact copy of the AOS application that I filed. It also says that if I change my name I should send proof of name change such as marriage certificate etc. and I sent the marriage certificate too. I don’t know what to do. I’m worried since that they will base the investigation on the evidence that I will send for the rfe and if I send it again, How would I know they’ll acknowledge the name problem if they didn’t acknowledge the ones I sent before? I can get a denial coz ill be sending the same thing i sent before. is it possible that there was just some errors?

The exact same thing happened to us (RFE for the i-131and i-765 due to name inconsistency). I sent identical responses to both RFEs, since they were about the same issue,: I added a cover letter explaining I changed my name in occasion of marriage and stating the additional copies I was enclosing to prove it (passport with maiden name, new passport with married name, SSN card with new name, and an additional copy (uncertified!) of our marriage certificate (I even drew an arrow pointing at the name change part and highlighted the explanations I wrote on the margins). My status has now changed to “card was mailed to me”, so it worked.

you are lucky coz you have an SSN and new pasport with new name. for now all I can provide is my marriage Certificate and my letter explaining how I changed my name (I also did that arrow thing, hilarious lol) I just hope it’ll be enough. Since that you also received separate rfes for the two application, did you mail the evidences separately?

It was not easy to get those documents, though. For the SSN, the officer didn’t know whether it would be possible to issue a new card before the combo card. They said it would take 30 days for me to receive either the new SSN card (I had one with my maiden name on it from when I was an Au pair) or a letter explaining the reasons for refusal. I ended up receiving a new SSN card after 35 days. My SSN office is in California

For the new passport, I had to go to my consulate in San Francisco and register my marriage there (my husband had to be present). The process took 15 days. After the marriage was registered, I applied for the new passport, which took another 2 weeks to get ready.

I had a gut feeling I should have the new passport issued sooner rather than later - and it turns out I was right about it.

I sent both RFE letters separately. Just to make you feel better about your case, I STILL HAVEN’T RECEIVED THE PHYSICAL LETTER FOR THE I-765 RFE! Either USPS lost it or they messed up at USCIS. I received the RFE for the i-131 all right, and a week later I started calling USCIS daily asking why the other RFE didn’t show up. They said if it didn’t show up in 30 days, I could ask for a new copy to be sent. I went bananas. I asked to be transfered to a Tier 2 and they promised to fax it to me the next day. They never did. I called again. Next officer made the same promise. Fax was not sent. I called again and asked Tier 2 officer to transfer me to their supervisor (Tier 3? LOL), I was livid. One thing is saying there is nothing to be done; another is to promise to do something and fail to do so. It was USCIS’ word and USCIS’ credibility at stake at that point. The Tier 3 officer faxed the letter to me immediately, said he would call again 40 minutes later to make sure I received the fax, and indeed called again 40 minutes later. I got the fax. He apologized on behalf of USCIS.

Bottom line: squeaky wheel gets the grease.

wow, I bet your heart was like in your throat for all the inconvenience. That was crazy and a lot of cliff hanging situations. I just called yesterday and the lady said send it anyway even if i’ve sent all of them with the application. She said that sometimes it happens that the agent loose the papers (interrupted me saying “however it doesn’t mean that’s what exactly happened”) so she said just follow the instruction on the rfe. I received both rfe same day, so do you mean send them completely separate? like different tracking? I was thinking of doing that but I was thinking too if I should just put them in a two separate yellow packet/envelope, then put the two packets in bigger yelow packet.

Yeah, it has been an emotional rollercoaster.

I think you should do what you said: send both sets of documents in one envelope, but make sure you keep the two sets separate. You can put each set inside a plastic sleeve, for example, and label them "Response for I-131 RFE" and "Response for I-765 RFE" - just in case. Rooting for you!
