Timeline

Hi all, my visa was issued on 14th April 2015, but still I am in my country. Can anyone tell is it necessary that I have 90 days visa left when I enter in USA? They issued me almost 6 months visa and almost 2 months have been passed. I am planning to go to USA in july. But I would have almost 83 days left in my visa if I go in july . Plz guide me thanks

Once you are inside the USA, you have 90 days in which to get married.

Yes, I think what Darnell is telling you is that if you enter the US on July 15, 2015, then you have until October 13, 2015 to have a valid marriage certificate. You need to enter the US before the six months on your visa expires, then you need to marry within 90 days. Then you adjust your status because you become eligible for permanent residency; however, you don't need to adjust within 90 days, but you will be accruing 'overstay' time (I think). But that shouldn't affect your residency application.

ya, i try again.

the dates printed in the visa foil stamp cover only the duration of calendar time one has to enter the USA.

Once you enter the USA as a K-1 visa holder, the visa is invalidated at the POE, as the K-1 is a single-use visa.

Once you enter the USA as a K-1 visa holder, an electronic I-94 document is issued (you need to download this after POE) and your lawful presence is governed by the I-94 document, which is usually 90 days.

During this 90 days past the POE date, you are to get married. Get married under that 90 day window? Then you are allowed to file for an Adjustment of Status, ultimately ending with a green-card issuance. There is no deadline to file for AOS, only a deadline of when you must be married.

Let's say you file the adjustment of status 180 days after the I-94 expires. Once the green card is issued, any overstay is automagically forgiven by USCIS, you not need to do anything about an overstay if you followed the rules.
