Hi, me and my wife are in similar condition we filed I130 in December 2014 and got letter from Local USCIS office (Memphis) that interview is required they set a deadline of 240 days which will come in FEB 2016. Our lawyer advised us to wait till August because he is hoping that Local field office would call for interview soon but if they do not call then we might see congress men or what ever. going for interview is not an issue for my wife too but the problem is waiting time as they mentioned on letter 240 days that's so long, earlier we were thinking that i will have my interview at Abu Dhabi embassy by before Feb 2016, but now we are still waiting for I130 approval, please let me know how this K3 things works so i can advised my lawyer too.

I definitely will let you know what happens. Sorry you are going through this too. Like your wife, the interview is not an issue for me either, it's just the waiting. It's very unfair to wait that long just for the I-130 decision especially since it's the only the first step in the process.

You may want to go ahead and file a K-3 as well. It doesn't cost anything extra if the I-130 is pending. I know it's not likely to get processed first, but I think it also shows we are serious about the process plus I was able to submit additional evidence with it, like another trip to visit my husband since the I-130 was filed, more pictures, more call logs, etc.

your right but i was reading that i129F takes 5 months to get approved since our case stuck at local field office so this i129F can stuck there too you never know their stupid rules i would say you contact your senator and describe him the issue as per law i130 should get approved in 5 months no matter what happens as backlog my lawer will do something in september first week as of now he want us to wait till august i129f seems like lenghty since i am eligable for IR1 visa with 10 years GC.

I have thought about contacting someone. I may do that very soon. I was finally able to put in an online service request and it said I should have a response by August 8th. I think I will let that play out and see if it brings any answers. Then I will go from there.

As for the I-129F, I filed that a month ago when I thought it would be at least 6 months until an interview. My hope was that it might get processed without needing an interview. Probably not, but it's worth a shot.

In the meantime, I also have a trip planned for September 18 - 28 to visit my husband. I just hope that I don't get scheduled for an interview during that time!

my wife is also coming to see me on oct mid she is worried too what if she missed the interveiw lol my wife is coming for 2 weeks only.

i wish all the best for both of us but sometimes i worry why they asked us for interveiw only lol me and my wife has some backlogs for them i guess but lets see its sound like a fun fihance can get visa in 5 months and spouses are getting visa in 12 to 18 months such a amazing law.

i will update you once i hear anything from memphis office

It's not really a law, but the reason is because the spouse comes over with permanent resident status, social security number, work authorization - everything. Fiance doesn't get that until after AOS, and that process can take the same time. I'm glad the EAD is processed separately, but we are still facing a long wait too. So it's a trade off - either have everything when you enter and wait longer out of country or get together sooner and wait longer for everything.

Yeah i can understand but living with your spouse is better then to live separate from them my wife lived with me 2 years after marriage and time passed very quickly but now she is separated and time is like hell i would ask her to return back but the problem is we do not have any financial sponsor other then my wife so we have no other choice to live separate.

I wish our spouses and fiance's could get visitor visas more easier. If that were the case, though, we would have had to start over with a spousal visa if he could visit me here! The waiting wouldn't be so bad if we could visit each other more freely.

I believe the Form I-129F and I-130 are processed separately. Yes, while the USC will put his info on the Form I-129F, they process them both separately, from what I have read.

If the petitioner gets lucky and has his petition routed to CSC, it would beat the CR-1 to Pakistan, and the K-3 won't get canceled if his CR-1 is waiting in Detroit. I would try the K-3 before the congressional grievance. Then, if your K-3 is mis-routed as well, then you can show that you have taken all appropriate steps.

Btw, I don't think it costs extra, so I really don't think you have much to lose. The only thing is if you get TSC, that will take a very, very long time to get approved. If you can move to Pakistan, can you move to California (or another state that CSC covers) before filing the K-3? (Just a thought...)

And speaking of stuck...still stuck!! I put in a service request. It came back saying your interview is not yet scheduled and we have no timeframe to give you. Duh, I already knew that and was hoping for something a little better. So I sent a note to my senator. We'll see what comes of that but I'm not crossing any fingers. And in the meantime, the I-129F is sitting at NBC or perhaps the filed office. No clue! But it's not bothering me today because I just scheduled a visit. Heading over in one month for an 8 day visit. Now I have something to look forward to while waiting. :clock: Maybe I'll come home to some good news. :joy:

hey just let us know what did they replied m going to file 129f in September its been 8-9 months since we filed i130 and no interview call yet sad situation we hope we both get out of this waiting game soon.

Your timeline says you haven't responded to your RFE. So it looks like you are just waiting for the approval of your RFE if you sent in the requested documents. The I-129F won't help you too much if you are almost there.

1. an ISO can tell you the physical location of the file. Not easy or straightforward to get to an ISO, so bear that in mind.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
