Hi,

I have a question.

My fiance is entering the US on a K1 on 4th of April.

We will get married on 23rd of April and then file AOS, Advance Parole and EAD as soon as possible.

1.Can we file all of this together? (We are in California)

2. And even more important, about how long will the AP and the EAD take?

Thanks a lot!

Most everyone files AOS, EAD, and AP at the same time. As for how long the EAD and AP take, that's hard to say. The EAD typically takes 90 days, AP not quite that long. BUT, it depends on when USCIS gets the applications and when they get around to processing it. You can look at our timeline, in my signature, to see when ours was processed. Just don't make any plans to leave without AP being approved.

Thank you for your answer. I just saw you got a biometrics appointment. are there any times when my fiance has to be in the states to attend any appointments. our plan was to file aos, ead and ap end of april, for her to leave in july, and then to start working in september. do you think that might work out?

Don't plan on anything until you actually have the documents in hand. My husband's biometrics was in August. She has to be here for biometrics for certain. It's possible your plans will work out, but don't plan on anything until you are approved.
