Seems like everyone is in the same boat now.. I hope everyone has good luck with their applications.. as for going for K-1, I can't go that route because she was already married before.. I thought that you can only do K-1 when you never been married.. Also, the US government crack down on people from Asian countries :crying: so applying K-1 would make them suspicious of her.. and I really wouldn't want that to happen :wacko: a lot of the stuff is "made in China" anyway, so why can't the people be too? :blush:

I-130 STAGE 1 : 533 days - 1 year 6 months (4/16/2007 to 9/22/2008)

Transferred to local office based on "security checks" : 11/27/2007
wrote hundreds of letters - received letter from FBI Records Management Chief stating no security checks
local office interview : 2/21/2008 - brought my parents too (result : you will get approval within 2-3 weeks)

5/2/2008 - (lawsuit) Writ of Mandamus - OFFICIAL DATE (7/29/2008)
9/22/2008 - CALL AND EMAIL COPY OF APPROVAL NOTICE FROM LAWYER

NVC STAGE 2 : 99 days - 3 months (9/30/2008 to 1/7/2009)

Just checked my bank account and the check for $190 was cleared today!!! :dance:

I still don't have my NOA1 BUT... I'm sure it's in the mail??? :unsure:

Just checked my bank account and the check for $190 was cleared today!!! :dance:

I still don't have my NOA1 BUT... I'm sure it's in the mail??? :unsure:

Probably is :) Are you checking your status online?

I just checked with the USPS tracking system and found my petition was delivered on 2/17 at 9:28 am. Odd that they deliver on a Saturday, but whatever :P

Is the additional proof from part 7 always required? Is it required for both I130 and I129F petitions? Also if it isn't sent does it mean i will get a RFE?

I spoke to a lawyer before i started the I130/I129F petitions for my wife and the lawyer told me i don't have to provide additional proof beside the normal requirements (Marriage Certificate, Passport Photo, and G325A) when i file for I130 but my wife will need to provide it when she goes for her interview.

Yea, it's required now as of December 2006...they always have to make it harder it seems.

Is the additional proof also required for I-129F/K-3 Petition? If I-129F doesn't require proof from my side then should i even worry about it since i don't plan to pursue I-130 petition anyway.

Also for my I-130 petition should i contact them and ask them if i should send the additional proof now or wait for the RFE to come and then send it? I can just send all the proof to my wife when ever her case opens and she has to go for her interview.

I haven't been able to check my status online since I don't have a case number assigned yet. I read somewhere that they write your case number on the check but the copy that my bank has of the check online is really blurry so I can't see it.

The waiting continues... :wacko:

I just checked the I-129F form and it doesn't really say that you should send proof of marriage. It does say proof that you have met before filing, so I think the marriage certificate and other evidence should be submitted.

As far as the I-130, I noticed that you received an NOA1 already so I would wait for them to send you an RFE regarding documentation. What do others think?

That's weird,we had our NOA1 date -02/08/07,received the actual receipt on Feb,14, bet check hasn't been cashed yet-you see every case is different :thumbs:

haha, it says YOU SHOULD, then they SHOULD give you a visa.. haha.. but that's not the point.. it's better if we send in a lot of things for proof, and not just try to send in the minimum... but that's your call :whistle: you might get a RFE, you might not..

Still no NOA1 in the mail but after staring at my cashed check for like ½ hour, I figured out the chicken scratch of my receipt number that was written on it. Went to the USCIS web site, plugged it in and lo and behold there it was. It says they recieved the I-130 on 02/14/07 and that a notice of action was mailed out to me. Uhmm... it's now 02/23/07 and still no NOA1. Called customer service and prompt says to wait 30 days from date it was mailed out. Sooooo... 03/14/07 it is, that's if I don't get it sooner. And I need it so I can submit the I-129F ASAP.

Bummer. :cry:
