Are there any other K-3 February filers? I sent out the I-130 for my husband on 02/05/07, USCIS received it on 02/08/07 and I'm still waiting for the first NOA. I am not the patient kind so I hope that by reading your timelines I can feel better about all this waiting. <_<

next week planning to file for K3

I guess you should receive it next week,I've heard taht vermont is a little bit faster than the others so you shouldn't be worried :thumbs:

all right!! Feburary filers... what kind of information for #7 (the new rule addition) did you guys/girls add? I wanted to find out the "proof of ongoing marriage" and what you included.. (tickets, receipts, pictures (wedding and others), phone records??) I know that all this stuff was supposed to be for the final interview.. but the new rule in #7 wanted proof right now..

please help :help: for your infor, there is a new form expired in November 30, 2007.. the 'old' form expires in January 31, 2007.. so I'm not sure I can still use the old one.. other people said that I could.. just more verification would be helpful..

The only proof I sent were 2 affidavits signed by my mother and sister explaining how they knew about the relationship and that they were witnesses of it being real and legal. They also stated that they fully supported us being together and all that other mushy stuff. Item #7 of the I-130 asked for property records or bank records with both our names on them, so I couldn't send them since my husband and I don't live together yet. If they ask for an RFE, then that's when I'll send in the pictures, plane tickets, phone records, etc. to them. Hopefully not since that'll delay the process even more. :wacko:

As a proof we sent a lot of staff

pictures from our wedding day,even DVD with the wedding

the only one picture that we had showing that we knew each other before the wedding

2 affidavits from friends stating that they know about our relationship and were present at the wedding

a property record with both names on-that we pay the rent together

a couple of emails that we used to write all year long,but they are in Bulgarian so I don't know if they are worth

But it seems people still dont' know much about the 'new rules' on the I-I130 #7.. actually if you look at it, they WOULD LIKE to have the property, joint accounts, and such.. I was wondering if I could create a joint account at her country (China) when I go back in March.. That would also add to the proof.. I guess some wedding videos/photos and the affidavits (that is #5 under the #7 rule).. there are total of 6 things you can do under #7.. most people can go with #6 *** Any other relevant documentation to establish that thereis an ongoing marital union. ***

The instructions appear to allow for affidavits from related parties, as they state to include "his or her relationship to the petitioner or beneficiary, if any." I think it's a good sign that the family is willing to give their affidavit.

If you are not yet married why don't you just go for a K1?As far as I know it takes about 6 mounths but the chance of getting it faster is much bigger rather than if you go for a k3.If you plan to get married in March you'll waste another 1-2 weeks until you get he proper documentation ready,so you are not gonna start the K3 process before April,and K1-you can start right now.

Besides,for both you have to send the same amount of evidence (as if the marriage certificate doesn't say you are married :angry: )

My husband has sent our I-130 petitions /for me an for our child/ at 15/02/07. He has sent as an evidence of ongoing marriage only the birth certificate of our child.

I think this is sufficient. What do you think. Is it necessary to send other proofs /photos, tickets and etc./ when we file for I-129F.

I filed for my husband on the 18th. It was the soonest we could do as I was in Finland for the week previously, as it was the time we had planned on doing DCF :angry:

Then the documents he mailed me in January didn't arrive in the US until after I left....but anyway. Now that the long weekend is over, VSC should receive my I-130 today. I have nearly everything together for the I-129F, except the payment, and will send that off AS SOON as I get the the NOA :)
