Yeah, USCIS seems to be good at losing documents or missing stuff in the file. Two recommendations:

- Make sure you add a cover letter and in the cover letter put a list with every single document you submit. This will make it easier for the person going through it.

- Make a duplicate of the entire package before you send it as well, to know exactly what you sent.

Thanks, I will. I will explain in detail what each item is and why it is submitted as evidence. In my package for application I sent a cover letter listing every document I included and a table of contents, labeling each document, and i put mini tab things on the bottom that were also labeled to make it easy to flip straight to the exact evidence document. And I kept a copy of the whole file. I fastened it using acca fasteners to make it easy to flip through,an to transfer to their government folders.

I was in removal proceedings, the proceedings have been terminated by IJ after my standalone I-130 has been approved upon a stoke interview in August 2014. Afterwards I waited for 10 extra months to file AOS to avoid becoming conditional LPR. I-485's NOA1 date is June 17th and I got the biometrics done on July 7th. Waiting to receive an interview date. Hopefully it will be scheduled on or after 9th September so I will be able to become an IR6 not CR6.

What evidence did you send?

that's the problem I did not send any evidence because the lawyer did not ask us to give her any to put in the package. So now they request pay stubs n job letter. But if u check bubblz he send all the evidence yet he get RFE. Edited by Shacanus

I almost get the same as you they said my sponsor did not meet the 125% but according to her yearly salary she did meet it, that's why the lawyer did not advice to get a second sponsor. Now im sending back info with a co sponsor But I have to wait a few days for her to get up the nessasary documents. I printed out my I-94 on line one page I did not get any RFE for that. So I'm in the waiting zone also for my co sponsor to get up her documents and yes they notify me that the put a hold on my I-485 until I send back the nessasary documents. Felling sad but guess that's life.

Yes, I'm sure it will all go well after this. It really does make me feel sad being so helpless.

But I must say, it looks like we are really application twins. lol When I got the text about the RFE I was thinking "well at least Shacanus will be able to go on to completion smoothly and I'll get to see how quickly everything could have been done if i didn't get the dreaded RFE"

I'm hoping we get all our extra evidence in the next few days so they can receive our new evidence by the end of this week. One week delay won't cause us too much delay in our processing.

I got my RFE letter and I really don't know what to make of it. I don't know whether to laugh or be disgusted. It's asking for initial evidence for two things. It claims that:

1) Based on the documents submitted, the joint sponsor's income did not meet the 125% poverty guidelines for their household size and that I need to submit evidence of assets, which must equal five times the difference between the income and the poverty guideline. Or get a new sponsor.

2)I need to submit evidence of my lawful admission into the US. Such evidence includes i94, etc.

So, I am really doubting the, uh, caliber of people who are responsible for doing this paperwork because

1) My joint sponsor's income is significantly more than the 125% poverty level. With my i864 I sent an employer's letter verifying income, 6 months of weekly paystubs, tax returns and w2s. So, I will resubmit all the paystubs for this year so far, plus I've asked joint sponsor to get another letter from the employer, dated this week, plus 12 months bank statements. Hopefully this time the person dealing with my file will be able to recognize that the joint sponsor's income is $20000 more than the 125% poverty guideline for the household size.

2) In my application I included a printout of my electronic i94. I even included info on my travel history into/out of the US for the past five years, and I even included info on my previous passport, since my current passport was renewed a couple of years ago. So, I went to the i94 website and printed out another copy of my i94. Hopefully the person dealing with my case will be able to recognize the i94 this time.

I'll probably have to wait at least a couple of days before joint sponsor gets the new letter from the employer. It is frustrating to know they stopped working on my case for no reason. :-(

Yeah, that is really sad.

Did you keep a copy of your AOS application? You could check that. But there are many cases that USCIS lost the supporting documents, so no surprise there. Just resend another one ASAP so they could resume working on your case.

Did anyone else have any update on EAD/AP or case ready to be scheduled for interview??
