Now, lost_at_sea, What would you recommend? If I wanted to get married to this girl. What would it require?

I would recommend that you work out where you actually want to live. US or Australia?

You can marry her right now, but that's not relevant to the question. Where do you wish to live?

I would want to live at home eventually. However, while she finishes her degree, I would hope to live here and work. (Q. Is that even possible?)

University degree: It is in house and so I could return to that. OR I could potentially do it online. I also have job offers from back home (which are dated for two years) I would return to those with my wife (hopeful wife).

I just want everything to be legal and legit! And I understand how it is confusing for you.. as it is confusing for me. there are many paths of the future which can affect what I even do.


And please forgive me... I may not realise something is a complete abuse or something similar. So please pull me up and give me an alternative option.

I would start with your prospective Employer and their Immigration Lawyer, non profits are not subject to Cap so that would be the quickest.

Your tourist visa doesn't allow you to work, so that's out of the door. Non-profit or not, you can't work. You can look into getting a work visa, which your employer can advise you on (they have to petition for you, anyway, so it's necessary that you talk to them).

If you got married in the USA right now and started the adjustment of status process, then it would probably be about 3 months from then until you could legally work (you need an EAD document). Also, if you get married and leave the USA, you're not eligible for that path anymore and would have to file the whole thing with you in Aus and you wouldn't likely get your CR-1 visa for about a year (which would be what you need to work and live in the USA).

Bear in mind that arriving in the USA with intent to get married and adjust your status is a misuse of your tourist visa (i.e. having immigrant intent at the border). You're already in the USA and now you're thinking about getting married - you could do that, but you can't leave the USA until you've got your AOS complete or your Advanced Parole (a document that lets you leave while AOS is pending - also takes about 3 months).

Given that you're talking about the end of the year for going back to school, maybe you should just straight-up be looking at her Australian visa and get on that. That process will be a lot faster than the US one, I imagine. Does she work / have school? Does she want to move to Australia? Like, what's more important - living in a specific country, or living together ASAP?

The first thing you need to decide is if you want to go back to Australia in August or not.

If you can give it up, you might be able to apply for AOS IF you didn't abuse your visa.

If you can't, then you need to apply for a K1 Visa or family reunification if you get married prior to filling complete paperwork. Either way it is 6 months-1 year before you can be together and 1.5 years until you could work in the US.

Going to Canada will not change the visa. It used to be that simple for a few visas years ago. Not anymore.

A clarifying question about the job offer. You originally said you would be an Australian correspondent. Is the broadcast of the material for use in Australia or for use in the US? If for use in Australia, you might want to take a look at the requirements for an "I" (journalist) visa. Not enough info provided about the company or the exact position, but you could look and see if it meets the requirements for the "I". That visa allows you to live/work in the US for the duration of the visa, but has specific requirements on what type of media work can be done -- the broadcast audience, for eample, must be overseas, not doemstically in the US.

No going to Canada will not re-start the time again to garner another 6 mths

just as one cannot be a tourist in Canada visit the US & re-start time allowed.

Most CBP & immigration guys/gals does not know immigration laws they just

enforce what they should &they tend to give wrong info a lot....You can marry

go home while she start the petition & visit time to time showing ties to your

home for another 12-15 mths
