also, on the website it says that the petitioner, applicant or legal representative can call and get information about the case. on the phone, the officer refused to give my wife any information, so she had to come get me and i had to talk to that person.

usually i call them myself anyways, but today we thought my wife should try to talk to them, because we felt that maybe they take a US citizen more serious than the foreign spouse.

Anyways I thought that was strange that they wouldn't give my wife (who's the petitioner!!) any information.

Sorry puffers - I'm traveling so not on here every day. This is standard - asking to talk to the applicant for this part of the process. I've called several times (I'm the American and more comfortable with paperwork type of things) since AOS was filed and each time they ask to speak to Kevin to authorize speaking with me. When you get transferred to Tier 2 they too will want to speak with the applicant.

Regarding a delay because of AOS RFE. We too received RFE but have received the combo card. Also I've researched this topic here and elsewhere so I'm not believing the Tier 1 response to you that RFE causes a delay.

When you call again to talk to Tier 2 couple things. 1) call either early or late in their day. The middle of the day is the worst time to try to be transferred because it's their busiest time. During K1 Tier 2 would get backed up with calls so they would tell Tier 1 not to transfer. 2) If Tier 1 tells you they will call back, asked to transferred to the automated line that process Tier 2 return calls. 3) If they say RFE delays the EAD tell them you have a friend (online so what) who applied around the same time you did and they received their card on the 20th. 4) I never lied to get to a Tier 2 officer. Each time I had a question they could not answer, so I asked them to transfer me to someone who could or I was outside of th 75 days. 5) often it depends on who is at the other end of the line. There are so many of them. Call again.

My advice to potential k1 and green card filers. Move to sunny Cali before you file; this state has their act together!

My AOS was being receipt on June 08 (shown on website), and this morning, I called the USCIS, firstly spoke to Tier 1 and then transferred my call to Tier 2. I talked to him and explained that it's been more than 75 days now and I heard nothing, I need the EAD to apply my DL here, he checked and checked, then finally said that my case still pending, and I have to wait, their "normal" processing time is within 90 days upon NVC receipt my application, and he said not June 08, it's June 11 instead, I said I dont care about 8th or 11th, 90 days is based on calender days or working days, he didn't answer, I keep asked twice, then I asked him is that I still need to wait 2.5 weeks more, then he keep saying their processing time is within 90 days upon NVC receipt my application. So, now I guess the only thing I can do is to wait 2.5 weeks.

My parents and sisiter will be coming in earlier Nov, I really need to have my DL soon, so I can start to go around and check out some places, well prepare for my parents arrive, I am getting very impatient ... haha

ROC Timeline

Oct. 25, 2017:  Sent ROC package via USPS

Oct. 27, 2017:  Package well delivered

Nov. 01, 2017:  Cheque cleared

Nov. 02, 2017:  Received the NOA by mail.  The date printed on NOA is 10/27/2017.

thanks for your advice.

i called again yesterday and again the lady wouldnt connect me to a tier 2. but she was actually really nice and said that i am outside normal processing times and that i can put in a service request (case inquiry) myself on the website. i did that, so we will see if that helps... hope i hear something today or tomorrow.
