Hi everyone

We are looking for some experts help! If anyone out there got the exact same RFE, what did you do???

We got RFE saying:

This office is unable to complete the processing of your benefit request without further information.

Please read and comply with the request below, then submit the evidence to the above address.

Include a copy of this letter and place the attached cover sheet on top of your documents.

BIRTH CERTIFICATE - NOT SUBMITTED

Please submit a birth certificate to establish the birth and parentage of -name-.

The birth certificate must be issued by the appropriate civil authority showing timely registration, date and place of birth, and parents' names. In addition, the document must contain the seal of the issuing office including the date of registration and signature of the registrar.

We submitted his (USC) birth certificate with the original I129F application.

The only thing that wasn't on that birth certificate we send in, was his mothers first name and it only states what county he was born in, not the city.

Is that the reason for the RFE?

Does he have to go to the local division of vital records to get a new birth certificate with his moms name on?

Or would they accept a copy of the passport?

(Please help, I miss my fiancée so much, I just want this waiting time to be over! 215 days since NOA1)

Generally speaking a birth certificate should have his name, his mothers name (maiden name) his fathers name if he has one, the place of birth, county and state.


I mean, they told you why you got the RFE, you need the mom's name, and the city of his birth. As for vital records, depending on what state he's in he just needs to go to his states vital records of where he was born. I'm in Texas but I can order my birth certificate with the seal from colorado at the website that the states vital records provide. Not every state has a website though, some you have to fax or snail mail an application for request for them.

He does need a more "legit" birth certificate though. It needs everything they listed:

I believe he will have to get a "long form" birth certificate. As they stated, it needs to have both parents names and where they were born. I only had my short form birth certificate and had to contact my vital records location to get a long form one with all the information required. I was able to just go through a website as well and my new birth certificate came right to my door.

He submitted a copy of the original birth certificate that was issued less than a month from his date of birth.

On the certificate it states:

Name

Gender

Place of birth (county)

Date filed

His dad's full name

The seal is also on.

It's a real certificate, not something fake. :)

There are short and long versions of birth certificates. No one is saying what was sent was fake. They just want a long form US birth certificate. It is used to prove the US citizenship. You can also use copies of ALL pages of a US passport instead of the birth certificate, though you should be able to get a long form birth certificate by ordering it through the court/vital records.

From Page 4 of the I-129F instructions >

5. What Documents Do You Need to Show That You Are a U.S. Citizen?

a. If you were born in the United States, submit a copy, front and back, of your birth certificate.

b. If you were naturalized, submit a copy, front and back, of your original Certificate of Naturalization.

c. If you were born outside the United States and you are a U.S. citizen through your "parent(s)", submit:
(1) A copy of your original Certificate of Citizenship; or
(2) Your Form FS-240, Report of Birth Abroad of a United States Citizen.

d. In place of any of the above, you may submit a copy of your valid, unexpired U.S. passport issued with a validity
period of at least 5 years. You must submit copies of all pages in the passport.

Yes, and that's why I wonder why they didn't give me that option in the RFE. But anyway ? we are sending the copy of the passport back as a proof of citizenship ?

I can't find the copy right now. Basically, I lost my original birth certificate so I requested one from the Office of Vital Records. The one I received and sent in had the same exact information as your fiancee's birth certificate but I still received a RFE. I did not want to waste more time or go through the hassle of getting another birth certificate so I just sent copies of my passport pages.

Your fiancee should be fine sending in copies of his passport pages. KayDeeCee provided spot on information as well.
