I am wondering about what the difference between "announce" and "declare". Would it be the same?

In what regard? Do you mean the difference between "solemnly affirm" and "declare on oath" in the oath of allegiance? I don't know of anywhere the term "announce" is used.

The word "oath" has religious connotations (the implication being that you are swearing in the name of your god). Some people object to taking an "oath" on religious grounds either because their religions discourage swearing and others object on the basis of non-belief. USCIS allows you to substitute the affirmation for the oath if you fall into this category. You must notify USCIS of this when you sign your oath/affirmation at your interview before the naturalization ceremony. Similarly, you can ask to omit the phrase "so help me God" at the end of the oath/affirmation. There's a question on the application that asks if you have any objections to taking the full oath (it's one of the Yes/No questions).

You may also request to omit the clauses related to combat and armed service, but this is slightly more complicated.

Hi everyone, I just recognize that in question of " Have you ever been arrested, cited, or detained by any law enforcement officer (including any any all immigration officials or the US Armed Forces) for any reason?". I have said NO in this question. However, in the past I have received the parking ticket from a police, and I also go the court. They have said there no record or anything in my profile. If the officer asked why I say NO in the application, what should I tell them? Please help me. This is my mistake. My interview is almost coming. I am so nervous now.

Traffic citations under the amount of $500 don't need to be reported. So no is correct answer if officer ask any traffic tickets or citations tell him/her yes I had one parking ticket went to court and took care of it. It would be nice if you could show court paper work not must though as there is no record exist. Some people just ask the court to give them paper saying no record exist and take that along interview.

I have to respectfully disagree. There's nothing in any of the N400 instructions or the Naturalization Guide or the USCIS Policy Manual that says that. What it DOES say is that you don't have to provide evidence for offences that are under $500 and not DWU/DUI related. In the adjustment of status application, on the other had, it very clearly tells you not to include traffic citations.

Visa Journey is full of experiences in which applicants were asked about traffic citations. It's also full of cases where the interviewer didn't care. So with this inconsistency, it's best to follow the instructions and list all citations.

This is easily corrected at the interview if forgotten on the application... that's no reason to worry.

Please read again what you wrote above in bold letter. If they don't require evidence it stipulates it not even a concern. One can mentioned all their citations to make things complicated if you chose to but its not required. I didn't .

Please feel free to interpret it as you like, but if they didn't want traffic citations listed, they would just say "don't list traffic citations". They wouldn't say "list all citations" and then say that "evidence is not required".

They don't require evidence of many things on the form (for example organizations or clubs that you have been a member of). That doesn't mean that you don't have to list them.

That's my interpretation.

But once again; there are dozens of cases on Visa Journey where interviewers have specifically asked about traffic tickets... they're pretty easy to search for. And here's one from another website (text below). Your interviewer didn't care and that's fine. Here's one who did:

I, along with my wife, applied for Naturalization on Feb 24th, 2014. While preparing the form, we both were debating whether to disclose the traffic citations (we both had one of each, hers was a speeding ticket in PA, mine a careless driving ticket it in NJ which was later dialed down to Obstruction of Traffic with no points). Both tickets had fines less than $100 and there are many places (including some USCIS literature) that states that if the fine is less than $500, no need to disclose those or at least submit paperwork for those. After researching for quite a while, we reached the conclusion that it all depends on the Interviewing Officer (IO) so better to disclose them.

We received our Interview Appointment letters in April (Mount Laurel, NJ) and after a week we both got pink colored letters that said that since we had indicated that we had had cited by a law enforcement officer, we must bring to our interview the certified court dispositions to the resolutions of those citations. I got mine from my municipal court (took a week) but since my wife had pleaded guilty to speeding and paid online, there wasn't any court disposition. So, as the next best thing, she went to the DMV and got her driving record transcript that said that she was a driver in good standing. We collected these documents even though the pink letter said no paper work is needed for traffic violations not involving alcohol and drugs and the fine was lesser than $500. We took those documents with us any way.

I lucked out at having probably the best and most polite IO. The lady was really courteous and kind. We zipped through the initial phase. I got my first 6 civic questions rights so she stopped there. She asked me if I was still with the same employer and I said no and gave her a letter from my new employer confirming my job change.

Then came the question of the traffic ticket. I gave her the certified court disposition with the fine of $36. She looked and sighed and said, "unfortunately, that's not enough. I need a certified copy of the police report". I told her that the pink letter stated that if the fine is less than $500, no paperwork is needed. She said that despite that letter saying that, the police report is a statutory requirement. I was bummed and she probably saw that. She told me that ordinarily, she would ask the applicant to mail the police report and then reschedule the interview, but in my case, she would make an exemption and if I can get the report back to her by 2:00 pm, she would recommend me for the approval.

In the meantime, my wife was being interviewed in the other office. She wasn't as lucky as I was when it comes to IO. After going through all the questions, the lady asked my wife if she was sure she was never arrested. My wife said that she was absolutely sure. At this point, her IO went out and brought someone else in who looked at the computer and said that well, there was something wrong with her background. After 5 minutes of going through stuff, the second IO said, "ah! it's not an arrest. It's a speeding ticket. Did you mention that on your N-400?" and my wife said that of course she had to which the second IO said, "good for you". My wife got the oath appointment for 3:00 pm and then we rushed back to the police station to get my police report.

With the certified copy in hand, I went back to Mount Laurel and asked to see the IO I had seen in the morning. She came out and ushered me back into her office. I handed her the police report. She didn't even read it. She just put it in the file and gave me the oath form.

And now we are proud US citizens.

Moral of the story: Disclose everything and if it's a traffic violation, go with the disposition AND the police report.

In the above case (and in many others) the interviewer went beyond what, in my opinion, is allowed; they asked for evidence... rather than face a delay, I'd rather list all citations and take what evidence I have with me to the interview rather than try to argue correct USCIS policy with the interviewer. But I hope we all get interviewers who say that they don't care about citations (and there are many, if not most, who do say that).

Totally agree with you,

I listed my speeding ticket back to 2012 on the form N-400 and it shouldn't be a problem. I brought the court disposition, proof of court payment to the interview. The IO asked my about that and did not want to see the proof. I also agree that people my interpret the USCIS differently, however, if you want to be on the safe side, list all citations that you may have. It does NOT automatically disqualify you from the naturalization.

My attorney told me they are not required to be listed as offence if under $500 and not DUI/DWI related. I think one should listen to his/her attorney if you hired one to do the very job.

My attorney told me the exact opposite.

I'm sure both lawyers are very competent and so the two responses, as well as the poll responses you posted, show how inconsistent interviewers can be on this issue.

My inclination was to answer yes to all of them. My lawyer advised me to answer yes to the first one only, because that is the one that specifically mentions being cited. I understand her point of view, but I thought that was a little strange and she said that she's worked with applicants who have said yes to all three and yes only to the first one. She always recommends that people with traffic citations answer yes to 23 and no to 24 and 25. She also said that when I get to that question in the interview, I should answer "No, except for my traffic citations" for 24 and 25. Since she's the expert, I followed her advice.

I like the approach of disclosing everything and then telling the interviewer that it's only for traffic citations. The interviewer can change the answer form a Yes to a No if he/she wants to (I've seen VJ members report this happening).

You can achieve the same objective by disclosing your traffic tickets on the time of interview without confusing the heck out of your application and multiple officers who are reviewing it. If you are applying the logic that traffic tickets are offence by answering 23 with yes then you should apply the same logic for 24 and 25. Where you are charged with offence YES (clearly). And if there is any fine or probation for traffic tickets order by court of judge will result in convection for immigration. So 25 would be yes too lets confuse them even more now with yes answer for convection.

"The Immigration and Nationality Act (INA), in one of its rare attempts at clarity, defines the term “conviction” as follows (INA §101(a)(48):

(A) The term “conviction” means, with respect to an alien, a formal judgment of guilt of the alien entered by a court or, if adjudication of guilt has been withheld, where—

(i) a judge or jury has found the alien guilty or the alien has entered a plea of guilty or nolo

contendere or has admitted sufficient facts to warrant a finding of guilt, and

(ii) the judge has ordered some form of punishment, penalty, or restraint on the alien's liberty

to be imposed."

I guess this is a Grey area but logically they are interested in looking at bigger things then your traffic citations which they say you do not need to provide evidence off. And you can always disclose them on the interview if they ask and provide paper work end of story.
