I cannot believe my hubby's ROC is still pending. We r one of the last 5 remaining. I wonder if we went late for the biometrics had an effect on this?

We moved apartments a little while ago and I updated my address with the USCIS. About a month ago I also sent through a copy of our new lease and flight information for a family trip to visit my family. Does anyone know if the USCIS is supposed to acknowledge receiving this by sending an NOA or update my online file? Or do they not do anything because it wasn't for an RFE?

They won't acknowledge it because they don't ask you to send ongoing evidence. You have to update your address, but you don't need to send additional evidence unless they RFE you. Imagine what a backlog it would cause if everyone send updated information each month.

Can some body please help me? I'm a little confused! :wacko:

I moved last November and I change the my uscis file address I also sent the application over the mail, and got a "confirmation" letter that reads;

After careful review of your request, it has been determined that your issues will be best addressed by the USCIS office jurisdiction over your case. Therefore, we have taken the liberty of forwarding your service request to the California Service Center. If you require additional assistance, forms....

Here's were I'm a little confused because my service center is Vermont and I have not gotten a notice or a letter saying other wise. I'm going to call them tomorrow, but in the mean time I thought maybe some one here could tell me something to get out of my confusion.

And I am sure this question has already been asked (feel free to send me to whatever thread the answer is in), but my husband's extension letter is only good through September. What happens if we still haven't received the green card? My husband is planning on applying for naturalization anyway, but will he have any problems leaving/coming back into the US, or getting a job with his expired green card and expired extension letter?

I just came back from a week in Japan. In the US, the agent made a comment about the green card still pending and I replied saying that this takes at least 6 months (I am an August filer) and that was it. In Japan, at the check-in counter the airline person (apparently they need to make sure that you have a valid VISA before traveling to the US) had to go ask for a few minutes, but it was OK.

I think confidence is key. If they ask you questions, just answer them stating the facts without worrying about it.

If you still haven't received his GC by September, you can schedule an appointment at your nearest USCIS field office http://infopass.uscis.gov/ and request an I-551 stamp on your husband's unexpired passport.

Correct me if I'm wrong, but the extension letter extends the validity of the permanent residency a year from the date on the extension letter (797 I think), not the date on the green card. So if your 2yr Green Card expires in September, and you applied for ROC in June, you would get a NOA 797 letter with a date in June after you apply saying your residency is extended by one year. But the extension is counted from the date on the letter, NOT the green card. I had called the USCIS office about this and this is what they confirmed.

This was important to me because I was applying for a visit visa for a week's stay in Ireland to visit in May 2016, but since they needed my residency docs (GC) to be valid 3 months after I return from Ireland, they could not process my application as the letter was dated June 2015. They did not care that my actual GC expired in September 2015, which I thought meant that the extension letter gave it a new expiry date of Sept 2016. Not the case. USCIS said the expiry is a year from the date on the 797 letter.

Again correct me if I'm wrong here.

It's a one year extension on your status as a permanent resident, i.e. 1 year from the date your green card expires.

The letter says "Your conditional resident status is extended for a period of one year" - my conditional status expired on January 18th 2016, USCIS extended that for a year so it now expires January 18th 2017.

My wife just received her Green Card and the letter saying it's in production on Friday Jan 29th. No text or e-mail, it just showed up. Thank god!!

Nope! It is extended for a year from the date your conditional (2 year) green card expires!

Ok I called again USCIS office again today... this time it was a nice lady who took her time and checked again while putting me on hold. Her explaining made me understand that once you apply for ROC, the I-797 receipt letter kind of becomes your temporary GC replacement, and the validity is one year from the receipt date on that letter. You from then on always keep the letter and green card together for proof of permanent residence.

The actual temporary Green card's expiry date becomes irrelevant at this point. This was also confirmed by the Irish Embassy that refused me a visit visa for a week's visit in May 27th, saying that the receipt letter expiry date in June was less than a month after my return to the states in June 3rd. They need a minimum of 3 months validity, which I initially thought was the case since my conditional GC expired 9/15/15, and logically would expire in 9/15/16 with the extension letter. But no. Again, I would love to be wrong. But two calls to the USCIS office and the Irish Embassy refusing me entry visa seem to indicate that I'm right when I say the new expiry date for the GC till they make a decision on the 10yr GC is based on one year from the receipt date on the I-797 extension letter.

EDit: For what its worth she said it was strange that it was taking so long for the applications to be processed. She said that they are currently going through March Applicants.

I have made an infopass appt, where I will explain my case to the officer and hope to get some sort of extension (stamp on passport?) to allow me to travel to Ireland. This means I need my permanent resident status to be valid until September, as I will be back in the states in June. Hope this works out :)
