End to DCF!!!

Timeline

US embassies with USCIS field offices eg. New Delhi and Manila have NO info on their websites

about the new legislation putting an end to I-130 filing at embassies/consulates. They still have info like they are still accepting

I-130s.

And if you look at other websites like montreal and sydney, they have clearly posted they are not accepting any I-130s.

Does that mean anything?

It means that consulates without a USCIS field office in their country are not accepting I-130's at this time. There are some rumors that DCF may be coming back, but there's no clear timeline on that. If there is a USCIS field office in country, you may be able to file with that consulate or USCIS field office... check locally to find out what your situation/residency requirements might be. There are several threads discussing the filing situation in countries with USCIS offices in this forum. Good luck!

I heard on Friday that the USCIS District Office in Bangkok is once again accepting I-130 petitions, with the consular section of the embassy once again accepting the fee payment for them. Processing time for the I-130 was said to be 2 weeks by a USCIS staffer at the office.

New Delhi never stopped accepting i130s

i contacted them after the postings of the hoopla a few weeks ago

also - my case was approved in november, so it was in the timeframe that could have been required the reapproval process. our case has been unaffected - i called all info lines to amke sure!

so - check directly witht he embassy that you would be going through. call them. thats the best way to get the right answer.

Jun 2009 Removal of conditions (approved in 2 months!)

You're really lucky!! Delhi didn't work out for us.... When I called the Delhi Embassy they told me I can't file for my wife from there even if I stayed for 90 days and inspite of having a 'Person of Indian Origin (PIO) card' - reason given - since I couldn't prove my residency in India (i.e. no taxes filed there, no Indian job, no utility bills, etc). I actually lived in India from 1989 till 2004 and had a domicile certificate for the state of Maharashtra, but am a resident of California since I live and work here, so it wouldn't be accepted.

And seems they're increasing the requirement from 90 days to 180 days this year!

Here's what I pulled off of their website -

Effective June 1, 2006, U.S. citizens who wish to file an I-130 (Petition for Alien Relative) for their immediate relatives must provide evidence that they are residents of India. Proof of such residency will include a U.S. passport with an appropriate long-term, valid Indian visa and a Registration Report and Residential Permit issued by the Foreigner’s Regional Registration Office (FRRO) of the Government of India. Additional evidence should include, but is not limited to, on-going employment in India, taxes paid in India, rent/property receipts, and utility receipts in India. In most instances a finding of residency cannot be made with less than 90 days continuous presence in India.

The 90 days continuous residence requirement ends May 31, 2007.

Effective June 1, 2007 the 90 days continuous presence in the above paragraph is changed to 180 days.

United States Citizens may file their petitions between 9:00 AM and 12:00 Noon on all normal business days. The Petitioners must comply with the filing requirements of this Office.

United States Citizens MUST BE PRESENT to file their petitions. If a United States Citizen is filing for a spouse, it is required that the spouse also appear so that immigration officials may ask any questions necessary for the adjudication of the petition.

Applicants who do not meet the above residency requirements must file their petitions in the United States with the Service Center having jurisdiction over their place of residence.

cant you apply now?

i promise you with no bills you can still get approved. many went after me that only had 90 days stay and they got approved just as i did. the person on the phone was proably programed to say those things. you should have gone into the embassy and tried to file. if they turn you down you dont have to pay. you only pay if your apprvoed. in fact - they dont even log it in or take any papers. so it doesnt even go into the system as a denial if you get denied.

anywyas soudsn like you already got things int he works.

i wish you the best while your waiting it out...........its sooo tough!
