2 Questions on obtaining a K1

Hi,

My fiance is in India. We are trying to get a K1 to bring her here to the US. Unfortunately our relationship is not welcomed by her parents, so there are a couple of things I am wondering:

1) She lives in Kolkata. She is not able to make the trip to the Embassy Mumbai or New Delhi for the interview. She does not driver there, and it is too far. Is there any way so she can interview at the consulate in Kolkata? I'm sure we are not the first couple asking this.

2) Because she lives at home with her parents, how much paperwork will be delivered to her home? If a lot, can she have it sent elsewhere? Maybe a PO Box or something?

I can only answer question number 2: yes, she can have it sent to a PO box or another address like work address if she is not comfortable having them sent to her home.

I don't know if this is 100% correct but it relates to another thread I saw with a situation like yours, it would cost a lot for that person to get to the embassy but they have no choice.

Only certain embassy's process interviews for a k1.

She may have no choice.

If they process k1s then maybe, my research states they do but it may be wrong or outdated.

Can she not call and enquire?

Yes, it is true that not all embassies process K1 visas. Hopefully someone from India can help you.

1) K visas are classified as Immigrant visas. You fiance will apply with the Mumbai consulate since Calcutta consulate does not process immigrant visas. I thought it'd be Delhi, but apparently Mumbai process all Calcutta consular district immigrant petitions. Most processing is online, but she'll have to travel to Mumbai for the actual interview.

2) She can give a neighbor\friend\relative's address where notifications can be delivered.

Email support-india@ustraveldocs.com with questions. They're pretty good with responding back within a reasonable time.

So usually a k1 on embassy websites fall under non immigrant.

Yes and sort of no... Yes, it is classified as a non immigrant visa with immigrant intent. No, not all embassy websites put it under non immigrant. The US embassy in Sweden puts it under immigrant visa so apparently they do it differently all over.

Didn't say all embassy's did, I said usually, ie- most or some of them.

So what I said was correct.

Also, London is the same, it lists under immigrant. I was just stating that some do both which is exactly what you said so the reason to question what I said baffles me.

OP's fiance is in India.

On the US embassy in India's website, a Fiance K-visa applicant is classified as an immigrant; AND

K-visa issues are denoted under the Visas > Immigrant Visas tab; AND

Only Delhi and Mumbai consular posts issue immigrant visas, hence K-visa applicants are only interviewed at either of thsse two posts.

1. NO only U.S. Consulate General, Mumbai and U.S. Embassy, New Delhi do K-1 visa interviews so she will have to travel to Mumbai or Delhi, whichever place suits her. If Delhi suits more than Mumbai and if your case is transferred to the Mumbai Consulate by the NVC then you can always call the Consulate and ask for a case transfer to Delhi Embassy and visa versa if she prefers Mumbai Consulate and the case is transferred to Delhi Embassy. Mind you, the transfer could take a few days to a month, substantially delaying your visa process so it be better if she go to the allotted Consulate/Embassy for the interview.

2. I'm not through with the process yet but I was mailed my Packet-3 over my home address. Packet-3 contains information about steps to be followed before scheduling the interview and how to schedule the interview upon completion of those steps. But I read that after paying the visa fee and scheduling the interview at the allotted Consulate/Embassy, they also send you an appointment letter by post. Like I said I'm not there yet so I don't know if the appointment letter is mailed to the alien fiance's place or if they are supposed to take a print of an online appointment letter after scheduling the interview. So if the appointment letter is indeed mailed to the alien fiance's address then a total of two documents, the Packet-3 and the appointment letter, are mailed. If not then only the Packet-3 is mailed to them.

If her visa gets approved she could either be asked to come back later to the Consulate/Embassy and collect her passport or her passport would be mailed to the U.S. Consulate/Embassy's pick-up location in Kolkata. If the Conular Officer requires any additional documents to approve her visa she will have to submit the documents at a local drop-box (details be given at the interview).

But if travelling to Mumbai or Delhi is so difficult for her then I wonder how she is going to manage the medical examination because that needs to be done at least a week before the interview date and needs to be done from U.S. Consulate approved panel physicians only. To my knowledge there are no such approved panel physicians at Kolkata, i.e. she will have to travel to Mumbai to Delhi (whichever is allotted to you guys) and stay there at least for a week to complete the medical, biometric and the interview. So my advice would be to get things straight with her parents. Also the PO thing is not too big in India and mostly only companies (not individuals) have a PO address so she will either have to have the documents mailed to her place or a friend's/relative's or work place.
