I-129f Switching K1 -> K3

Timeline

I had originally filed an I-129f for my fiancee, but later we changed plans, intending to go the DCF route and obtain a CR-1 for her to enter the country after we married. As a result, we abandoned the previously-filed 129f.

Recently DCF has taken a hit, and I'm wondering if it's possible to switch the I-129f we filed for a K-1 visa over to a K-3 visa now that we're married.

Has anyone had any experience with this?

4/2005 Met Online

6/1/2005 Beginning of our relationship

8/17/2005 First phone call

12/26/2005 Finally met face-to-face in New Zealand

1/12/2006 Back home to the US. :(

6/2/2006 Kiwi arrives in Atlanta

6/28/2006 Kiwi leaves Atlanta :(

8/14/2006 I129F Completed and Sent

8/24/2006 NOA1 Issued

8/29/2006 -Touch-

9/4/2006 NOA1 Received

And so the waiting game continues...

No, you need to first file the I-130 get it past NOA1 then submit an I-129F that specifies that it is being used for the I-130 Case.

Process starts all over again.

This one was asked of the consulate in Guangzhou, here is their answer:

We decided to get married before my K-1 petition could be processed. What should I do?

If you get married, your K-1 petition will no longer be valid. Your spouse will need to file a different petition, Form I-130, with the CIS.

Nobody has experienced this because it cannot be done. It would be nice in certain circumstances but unfortuneatly you will need to start all over again.

As other have said it's not possible. Wow, your situation is really harsh with the changing to DCF and it blindsiding you. It's too bad you didn't continue with the K-1 because you'd probably be near finished by now. Don't mean to rub salt in the wounds but that's just plain bad luck. :(

1/12, 1/16, 1/17, 2/6 - Touches

02/06/07 - NOA2 from California Service Center

02/11/07 - Received NOA2 in mail

02/15/07 - Arrived at the NVC - MNL case # assigned

02/20/07 - Sent to US Embassy in Manila

02/26/07 - Received at Embassy

03/30/07 - Packet 4 received

05/09/07 - Medical scheduled (did early)

05/16/07 - Interview

05/23/07 - Visa Delivered

05/25/07 - POE in Newark, NJ

I-130 Timeline

11/27/06 - Mailed I-130 package to Texas Service Center

11/29/06 - Package received by Texas Service Center

12/06/06 - NOA1 notice date from California Service Center

12/09/06 - Touch

12/11/06 - NOA1 received in mail

02/06/07 - NOA2 from California Service Center

02/11/07 - Received NOA2 in mail (I-130 held at CSC)
