Ok so I said I would let you know what my RFE was for when I got it so here goes......

What the hell the people who work in these offices do Ill never know cos my RFE makes no sense whatsoever.

I know they have been sending them out for the I-485, which is exactly what mine is for. However, it totally contradicts itself and Im very confused.

Firstly, they are saying that I never submitted the I-485. Then on the next page they are telling me that based on the documents SUBMITTED WITH THE I-485 (that I supposedly have not sent!) I do not meet the poverty line!.

so which is it USCIS, I have or I have not sent the bloody I-485?????

My husband makes waaaaayyyyyy over the poverty line and we submitted everything that was required plus more than was needed.

Im just very confused, anyone else? :help:

I'm going to assume you mean I-864 since you are talking about poverty line ... First of all know this .. many people get this exact RFE and they get it for things that have already been sent .. it's just the way it goes .. I got the same RFE for my daughters AOS ( and we sent more then enough the first time )

Send a new I-864 .. and a new set of evidence ( everything they ask for in the RFE ) even if it seems rediculous ! If you read the rest of the paragraph " based on the documents SUBMITTED WITH THE I-485 "

you will see it goes on to talk about " income reported is sufficient but there has been no evidence submitted " it's just a section they print out and it applys to more then one situation ( Stupid YES )

So we sent them :

new I-864

2005 federal income tax

2005 IRS transcript

2005 w2 , 1099

New Work letter

6 months pay stubs

2006 W2 and 1099 with a note explaining we have not yet done 2006 taxes

Ugh, I feel you there. What exactly did you send? Maybe when you list it out we (as in VJ) might see something you could have done differently, although it's more than likely you got it exactly right and they are just idiots.

Just as a side, I know there is a big ACCO fastener debate, so I was wondering how many people got RFE's for things they did send (like them missing the whole I864 packet) that used the ACCO fastener, cause once you attach all of those documents together it's kind of hard for them to get seperated unless you take the whole shebang apart. Just my curiousity :)

About the ACCO fastener issue, I used paper clips, and everything was fine. For the I-864 issue, you just need to re-send them everything they asked for, on the RFE sheet. Yes, it is such a pain, but worth it. If you don't, your application may be denied. Good luck.

Oh yeah I know plenty of people have no problems, but I was wondering how many people who used the ACCO fastener got an RFE saying their documents were never sent in the first place. Just random curiousity really, I would think if everything is bound together tightly like that they'd be less likely to lose stuff but then again they may just take it all apart when they get it and so it doesn't even matter.

We didn't use the ACCO fastener because they apparently DO take the applications apart . . . We stapled related pages together then paperclipped all of the stapled pages together with a binder clip. We also included a table of contents page listing each and every document submitted. This might be an idea to use if you haven't as they can quickly check the table of contents and then match the coentents against it to verify everything is there. Good luck with the RFE.

We've never used ACCO fasteners, and we've gotten two separate RFEs so far. Makes me want to make the documents really hard to get apart. :innocent:

Conditions Removed! Ten-year green card received 6/24/2009. No more USCIS for a very long time.
