So my husband and i got married in Australia after living there for a couple of years together. We came to the U.S and i got my green card but after a year and a half of marriage he has walked out on me. He is now saying that their is no way i can stay without him so i should just go home.

Well this has become my home and i have a job and an apartment. I'm not ready to just leave this behind.

Does anyone know if this is true, i mean will they really kick me out if we're not married??

Any advice would be great.

i thnk if you received the Permenant resident card ( not the conditional green card), you are ok legal to stay.

but, if you have the conditional green card, you have to leave the country after your conditional green card expires, which this 2 year from the date the issue the conditional green card..

Hi Auschick,

I am so sorry to hear your sad news. I was reading on here somewhere that if the marriage broke down after a reasonable time you could lodge some form (???) which in some circumstances allowed you to stay if approved however I can't be certain. I am certainly no expert. I am sure some of the more experienced VJers will be able to provide the correct information for you.

Anyway, i hope you are doing ok, hang in there and good luck. I hope you get to stay.

hey just wanted to reply and let you know that YOU CAN apply to have the conditions removed on your own. All you will be required to do is explain what has happened and show USCIS that you entered into a loving marriage with the intent of spending the rest of your life with your ex. That is all they need you to satisfy.

So dont worry about having to go home, just gather any info, statements from family ect.. to prove that you married in good faith and you should be fine.

NO!!!

Getting divorced does not stop you from lifting conditions on a two year green card. As long as the marriage was "in good faith" (i.e. not just to get a green card), there is no reason why you can't continue to live the rest of your life legally in the USA.
