Using the cash assests in savings to meet income requirement for affidavit of support

Hi everyone,

I'm on F1 visa right now and my USC husband is planning to petition for my green card soon. We are both students and his income is around $15,000. The income requirement for a household of 2 is $ 19,912, which makes us about $5000 short to meet the requirement. I have read on the USCIS website that we have the option to use assets to to supplement the difference and we need 3 times the difference which is $15k.

I currently have $30k cash sitting in my savings account. It was recently deposited, thus it doesn't have a long history. I'm wondering - would this be an issue? Am i required to show proof of 12 months' bank statement or something like that? Or would a current bank statement be sufficient?

If anyone has experience with this issue, I would really appreciate your insight! Thanks in advance :)

If it was recently issued you can't use it.

They will see it was recently deposited and think it's borrowed to fill the requirement.

How did you acquire this money? If it was a gift, I wonder if you could get the one who gifted you to notarize a document stating it was a gift.

It's from my parents. Basically it's like my living expenses/tuition for a certain amount of time. I think I might just wait till we file our taxes next year because my husband just had a promotion and his income should be higher this year. I just don't wanna take the risk and receive a RFE if they determines that my savings history is not long enough....

You can override current tax by current income, which is demonstrated by 3 months pay stubs, company contracts, company statements...

They always ask for CURRENT income, and that matters.
