Okay now I'm just frustrated that I'm getting a million different things!! How are you guys getting this info? Because that's not what I'm getting from the actual offices when I call, lol.

I read what you're saying on the visa sites. Doesn't apply when I call them and ask, which is why I'm confused as to where you're getting this info.

Moreover, I went into our local bank and called twice. It's not them; their system won't physically allow it. Not adding him- but giving him his own bank account. They need ID, and he doesn't have it.

I also read about the 'not authorized to work' on SS card thing but when I called, they don't allow it. Please give me sources for this info so I can call because I hear what you're saying, but how am I supposed to do that when the office itself won't let me?!?

Okay, Darnell has a big thread on here somewhere about SSNs. And I'm going to be blunt, but most of the time? The SSA peons haven't a clue okay? So don't take what they say as gold, no matter how many times you go in or phone someone.

As for the SSA not allowing it? You take this print out in there, make them read their own instructions. https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530

Not every bank will allow it, no. Some will actually BYPASS it for you. And some are cool with it.

Our lawyer said she confirmed that we don't have an i94! What the heck guys?! Santy NEVER got one, and our lawyer said k1s don't get them!

The Lawyer is incorrect. I say that emphatically to you, as I am sure they will roll their eyes at being told they are incorrect... but they *are*. I94 are issued to K1s. This is a VALUABLE and important proof that is required for you to have for many steps along this process (even in getting on Obamacare). If no record of an I94 is showing up, typically you would have to return to the POE, go down to the inspections site and demand the CBP fix the database.

In fact I'd recommend you head into the SSN forum here and poke Darnell about this, he might be able to offer some help.

This is a stretch but try calling the JFK customs and immigration and explain to them you didnt get it. Sea and Air travel may be totally electronic now. However that doesn't explain not being able to find it. Make sure that they didn't make a mistake and put him in as coming in as a permanent resident rather than temporary.

And when you're finished, fire your lawyer (F)

I94's are online, and since he is not changing his legal name due to marriage, you can go to the SSN office. I brought my foreign passport, my online i94 and the SS5 application and they processed me easily! I also brought the part where it says that K1 are eligible for SSN cards but it wasn't needed. I plan on bringing my SSN and my credit card in my married name to the DMV to issue me a temporary license, maybe that's something he could do? Good luck!

I've been reading this closely because that's one of my main concerns. Doesn't make sense that someone enters the U.S. And there won't be any records. If you checked online with the cbp website and there are none, they have forms and phone numbers you can inquiry why and have them issue a copy or whatever is necessary. (does your husband have more than one surname? I have 2 given names plus 2 surnames so it won't show all of them on the i94, sometimes you have to try combinations of them to get the info from cbp)

As for the Ssn card, I know Darnell's made a really thorough guide. It seems people at the Ssn office are very uninformed and you have to be firm and insist to have things done. But in order to get a number/ card the i94 is needed. There's a window of time to have this done or then you'll need to wait ead.

There are a bunch of banks where a non U.S. citizen can open accounts. My suggestion is Google whatever banks are there near you + non U.S. citizens + documents + open account and the sorts. Some banks will request more than 1 form of photo id and no ss number. It's up to you to find one that's convenient.

Now, if they still give you problems, or you don't have confidence in them.. try a different SSA office that may be of more use to you. The i94 printout should be what they really need.

I'm just stunned that they (my lawyers & all the people I called) made me look/feel like such an idiot. I always thought VJ was the most reliable even though they say its not "official legal advice"! Hahah. Sooo Excuse my pages of ranting. This whole process has me out of my mind. From k1 to this!

Do they really need the i94 for the AOS? That's what it said on here, but she sent it without it!! Will that delay our GC or the EAD/AP, too?! Because we can't afford delays! Ecuadorian wedding at stake :(

Well it's people who have been through it. We are trained to believe that people with titles beside their name and education have the end all be all of knowledge, but the truth is experience trumps all. It's really unnerving that due to lack of experience your lawyer may delay you.

According to the USCIS's instructions for the AOS I-485 you're supposed to attach a copy of it with your form as evidence of eligibility.

Yep, as far as I was aware you're supposed to send it. Could result in an RFE, who knows though. Lawyer would be getting major eyebrows from me for doing that.

Right, but would that delay the EAD/AP or just the AOS? Not really concerned much about delay of AOS right now. AP is what's on my mind, lol.

Also just want to add-- My lawyers don't have a lack of experience in this field, which is why I was stunned, lol. One was a family friend of ours who transferred our case to our OTHER lawyer at the firm when he took another position. Both are incredibly experienced and qualified, but they were told wrong. My lawyer DID say that we needed it but when I told her we didn't have one she then said they said when she asked, they said it would be okay without one since I couldn't find one. Hence my confusion. Regardless of her legal advice regarding identity matters (the social security number), they were actually really good with preparing our k1 documents and, other than that, our AOS paperwork, too, and they advocated and called for us, as they should do!

As for the i94 thing, she called CBP to check and was given wrong info. Though I'm not happy with that, I wouldn't fire my lawyers or call them incompetent over it- they were also told improperly. We were freaking out over it because of sending it ASAP, so she just took their word at our haste to send, hahah.

So yeah, Ive just learned in this whole k1, AOS thing to just take any advice- legal or not- with a grain of salt, lol! :D

Yes, you're supposed to print three out, one for 1-485, one for EAD and one for AP. You'll most likely get an RFE so you can provide the i94
