You ought to

1 - learn to express yourself understandably, or get someone who can write your posts for you, and

2 - get a good immigration attorney.

But it seems from your 2nd post that you've seen an attorney?

Tell that to the USCIS and try to convince them. Then ask what the true reason for their denial was.

Yes, to you the marriage was and is real but unfortunately, not to the 'CIS.

And if you know the denial was b/c adjustment could only be done through the original petitioner, then; what's your quarrel here? If you know this, follow the rules, leave, and have your husband petition for you from abroad.

I don't understand what the confusion is here.

It has already been confirmed by the USCIS that the OP is accruing unlawful presence and will not be able to stay and adjust status.

They were told the unlawful status began 1 month after the divorce was final.

Every day here is another day of unlawful status.

Is the question when the last possible day to depart is to not incur a ban?

Timeline

Okay, the first marriage was real, but didn't you say you were 9-months pregnant when the divorce was final.? That means you were sleeping with another man while still married to your first husband.

It seems to me you must return home and wait for the USCIS to approve another visa for you to return to your second husband and that could take some time. Everyday you stay and every dollar you give the lawyer is just postponing what you must do.
