This is very odd and made me try to check my 1-94 because I had a return ticket which I never also.

Looks like I can't pull any information up for my 1-94 because it's been so long. I'm a little worried about this now.

I wouldn't worry too much; if possible compile evidence in advance that you did not leave on the return flight date.

At the end of the day, you didn't leave, and upon investigation they can find that out.

I went to my local CBP office, as did some others in this thread, and got any errors corrected; However, there are others in this thread that could not get the errors corrected.

10-31-2013 - Got engaged, started talking & preparing for spousal visa

01-12-2015 - Collected I693 (sealed) from Doctors Office

01-22-2015 - Received text message saying my package had arrived.

01-27-2015 - Mail received: 4x I797 NOA for I131, I130, I765 & I485)

02-03-2015 - Mail received: I797C, NOA for I485 & I765 - Appointment for biometrics in Boston MA is 02/20/2015

02-16-2015 - Mail received: RFIE for my I485 due to our unusual finances (we own a UK business, but do not work ourselves)

02-20-2015 - Went to USCIS Boston for biometrics; Arrived at 3pm, left at 4.30pm. Went smoothly & told I have "amazingly clear fingerprints!"

04-16-2015 - Finalized my response to RFIE; Response was over 120 pages, including 1 years bank statements from USA and UK.

05-12-2015 - myUSCIS case status for I-765 updated to "Approved" & case history shows "We ordered your card"

05-13-2015 - myUSCIS case status for I-485 updated to "Case is ready to be scheduled for an interview"

05-16-2015 - Mail received: I-797 NOA for I765 - Confirming my I765 was approved - valid from 05/11/2015 to 05/10/2016

05-18-2015 - text & email received, stating my EAD card has been posted today and should arrive within 30 (!!) days

05-19-2015 - EAD & AP combo card received in the mail

05-21-2015 - Visited local SSA office to apply for SSN - All paperwork accepted and card will arrive 7-10 days.

05-29-2015 - SS card received

08-14-2015 - E-mail received - interview is September 21 2015!!!!

09-21-2015 - Interview at Lawrence, MA - approved on the spot after just a few minutes.

09-25-2015 - Green card received with "Welcome to the USA" document.

what if your departure date was Jan 22nd and the marriage cert from Baltimore city court shows u got married there Jan 26th will i be ok? sent that with AOS packet obviously. And i have had bio metrics already in Baltimore also im fine right?

Hi. I'd like to share my experience since there's too many people concerned about I94 and the not accurate information that airlines give to CBP.

I came to the US in August 19 with a rountrip ticket. I never left on the return flight (originated from JFK the sept 12) but on the travel history said so.

Well. Never did nothing to change that.

Last friday I left US thru Houston and my Travel History was updated to remove the JFK Departure and they put my Houston's friday flight.

So I'm done with this. I guess CBP receive the airline info but they know we didnt left the country.

DAY 85 - May 27, 2015: Interview Scheduled for June 29, 2015.

When you are talking about the government process/procedure, why even take a chance that everything will be alright when there is an easy solution to all this (just cancel the return leg and maintain a copy for proof).

Personally, I would rather just cancel the return leg than leave it to fate that everything will work out.

Easy solution, yes. But for those that didn't do that, it's complicated. My wife has been trying to remedy this, but so far has been unable. Our local CBP offices have been throwing us in a loop. Between not answering the phone & giving us websites that we already have to email people we've already emailed, it seems we might be at a loss. They don't return phone calls & they don't respond to emails. This is proving unresolvable for us. But in the end, I don't think it's gonna be a big deal. I'm sure there are plenty of K-1 adjusters with this issue & I'm sure they're getting approved.

Haven't been able to get passed the phone blockade yet. & email is proving to be a useless loop. We really don't wanna have to drive 2.5 hours to try to just go there impromptu & see what we can find out.

Politely ask for the stonewallers' names and badge numbers, politely ask for the name of the shift supervisor, and then politely say that you need to speak with that supervisor.

Maybe you can find a personal or business reason to travel within range of the CBP station, in which case you can then pop in. It's a lot harder for people to blow you off in person than on the phone or e-mail.

I tried to argue my case for a good 20 mins but to no avail. Frustrating, as the 20mins we were 'arguing' he could of rectified the mistake.

I actually learned about canceling the return portion while I was researching about the K1 petition back in 2010 on VJ. Chuck this as a learning experience for others should they read this post. It's not about blame, but to inform others.

I guess the best advice if you are going to buy a return ticket to save costs is to:

a) Book the return leg as far off in the future as possible

b) cancel the ticket immediately, and get as much information about that cancellation as possible

c) file for AoS and advanced parole asap, hopefully the advanced parole is granted before an interview in case there is still a screwup - of course if your interviewer thinks you are lying about having left even with advanced parole, you could still be in a world of hurt

I have a similar issue, when I saw this thread my jaw dropped to the floor and my heart started pounding.

I went on a round-trip cruise to Bahamas with my then girlfriend/now wife on Valentine's day last year from Port Canaveral, Florida for 3 days.

I applied for AOS from H1B last month (May 2015) and when I checked my I-94 online it states that I have departed the US on 02/14/2014 and never came back. My last port of entry was 01/20/2014.

So I called CBP at JFK and spoke with a male customs officer. I Informed him that i-94 travel history online says I have departed US on 02/14/2014 and never arrived when I actually arrived on 02/17/2014.

Asked him if I will have problems with AOS.

He asked for my passport info and informed me that since my first H1-B visa was valid until 04/04/2014, H1-B extension approval notice date was 02/11/2014, my travel was Feb 14-17 2014 and my H1-B extension is valid until 03/04/2017 the extension approval i-94 overrides any travel/status issues and I must use that number for the AOS (which I did). He also mentioned that a cruise to Bahamas, especially a closed-loop one, is not considered a meaningful departure and that I should be all set and there will be no issues with AOS.

So yea call/visit CBP, they are very helpful and it's good to have peace of mind when hundred other things that you have absolutely no control on can go wrong.
