Please help me.. we planned AOS but may move to Germany!

Hello everyone,

I am here on a J-1 Visa and we plan on getting married soon.

As I planned on continuing working in the US we of course planned on starting AOS.

Now I got a job offer from Germany and my fiance (in 2 weeks wife) wants of course to join me!

How does it work then?

Will we apply for AOS from within Germany? We will be living in Hamburg.

Is it much more complicated? and is it a problem that we got married in the US? and then apply for AOS from GermanY?

Timeline

You can't apply for AOS if you're not intending on staying in US. You'd go to Germany and that's it. Then if you ever wanted to live in US again you'd apply for a spouse visa of sorts, prolly a CR-1.

But for now you wouldn't apply for a permanent residency 'cus you're not gonna reside in US.

You can't apply for AOS if you're not intending on staying in US. You'd go to Germany and that's it. Then if you ever wanted to live in US again you'd apply for a spouse visa of sorts, prolly a CR-1.

But for now you wouldn't apply for a permanent residency 'cus you're not gonna reside in US.

Correct AOS is for if you are intending on staying in the USA, a condition of the permanent resident status in the USA is to actually be a resident of the USA, not a foreign country.

What you would no is live in Germany and eventually if you wanted to move and live in the USA your US citizen spouse would petition for a CR-1, or IR-1 (If married more that 2 years) and you would immigrate and move to the USA from Germany.

The question makes some sense if you are asking what you need to do to enable your soon to be spouse to move to Germany, I have no idea but it should be on the German Consulate web site.

Your wife could bring you back to the US someday because she's an American Citizen. There's no harm in you marrying here and filing to live in the US years from now.

As Boiler said, right now you need to figure out Germany's requirments for her move there.
