Visting Husband While Waiting for K3

Well, I am going to take a gamble, be honest at POE and hopefully won't be denied entry.

The earliest time I would get my interview for a K3 would be May, but we all know all really long it could be.

I have decided to go to the US for a visit for a couple of months. (2 months)

I have with me a letter from my employer stating a leave of absence and my return date back to work, my car lease agreement, my apartment lease agreement.

Do anyone have any advice or suggestions for me? I would really appreciate it.

Bring a copy of your entire case with you, especially the documentation you have from the consulate showing that your case is there.

Bring al lthe immigration paperwork with u for evidence, ties to canada, and be honest. And have a back up plan in case u do get denied entry!! I travelled monthly to DC and never had a problem. My longest stay was 3 weeks. best of luck

don't sweat it.bring all your info and be totally honest with them, they will wanna see your return ticket as well. i have been several times for 6-8 week visits and never had a problem. in fact, im going soon for a 4 week visit

I got denied again recently. They felt I didn't have enough ties to Canada. It is so humilating to go through.

You have alot more ties that I do, I think you will be fine. Have a great trip!

I plan on taking that same gamble very soon. I'm going to do my interview waiting in WA with Lorry if I can

I've made 3 trips already without a problem but the longest was for only 3 weeks. This time I'm buying my return ticket out to 2 1/2 months Hope they don't have a problem with the length of time I'll be staying

My POE will be Halifax instead of Toronto this time. That way if I do get denied entry I won't be heartbroken to far from home

Anyone ever go through Halifax POE before? Are they as stern as the bunch in TO.

I wasn't sure if you've visited since you were denied entry, but if not, my understanding is that you MUST tell them upon your next crossing that you were denied the last time. This might make it a little more difficult to go for an extended visit.

chances are if you've been denied entry once already, you'll be denied again, unless you can show stronger ties than you did the last time.

Hi everyone,

I'm confused, so it's okay to attempt to have a Canadian spouse visit the US while waiting for his/her I-130 or K-3?

I know my husband called the port of entry twice in Detroit and the officers said it's okay, but our lawyer strongly advised us against it.

What are the consequences if you do attempt to come and visit, and get denied? Can you get barred for 3-10 years? Will that affect your K-3/I-130 application?

Yes one can visit, I belive this subjecty must be brougth up weekly,lol When crossing into USa, ensure one has ties to canada(letter from employer, lease, etc) and be honest, and dont have tons of luggage!! Yes they can deny you, so have a back up plan!! As long as ur honest nothing will really happen, just be told to go back!! If you lie on the other hand, well of course thats a different story!! I travelled monthly to DC while my Cr-1 was ongoing and never had a problem. Of course others have been denied. And when they went to the interview they stated so, and it didnt seem to be a problem (as long as u were honest)

I echo the sentiment of being honest with them. They're trained to spot lies (it's their job!) and you'll feel better telling them the truth as well.

Be honest, respectful, confident, patient and nice with them. They don't have an easy job and probably run into soooo many impatient ####### in one day.

A denial for lack of evidence of ties/returning to Canada will at most get you a bar until you have your visa in hand (seen it here a few times, but can't remember who) but it won't affect your case at the consulate. Many people here have been denied and just tell that to the consular officer and the reasons for the denial (lack of evidence of ties/returning) without any problems.
