I'm not going to use a lawyer, but when I did consult with some lawyers, they told me I will need

a notarized letter from my wife's child's biological father giving permission for her to be in our custody.

We are trying to avoid going to court, and just handle a written agreement. I'm wondering if anyone already

has a letter example or template having been in the same situation. I will also include a paragraph authorizing her daughter

to travel with us back and forth between the US and Canada using a Nexus pass. I'd like to do this all in one letter since

I have to get it notarized.

I do have some legal services that I can use, but if a general used template is available, that will be a start so that I can

present it to the child's father now and get his consent.

Any tips?

2015-04-20: We give birth to our son.


2015-05-03: We get married in Canada. (same date we officially became a couple 1 year prior)


2015-05-04: I return back to San Diego for work.


2015-05-06: I begin reading Fiance and Marriage Visas by Nolo (8th Edition)


2015-05-07: I find VisaJourney. Beginning the immigration process to have her, her daughter, and my son come live in the US permanently.

Our letter:

AFFIRMATION OF [ex-husband (child's father)]

Regarding the applications to obtain Legal Permanent Resident status in the United States of America made for:

  • [child's full name] [date of birth]

[ex husband], being duly sworn, deposes and says:

1. I am making this affirmation in connection with the application of my minor children, [child's name(s)], for an immigrant Visa to the United States of America. The contents of this affirmation are based on my own knowledge and are true.

2. I was born on [ex's date of Birth] , in [ex's place of birth]

3. My present address is [ex's current address].

4. I am the biological father of [name(s) of children]; their biological mother is [my name];

5. [my name] and I were married in [city/province/country] [date] and divorced in [city, province, country] [date]; and we share joint custody (or whatever your arrangement is).

6. [new hubby - USC] is a U.S. citizen and the step-parent of [child(s) names].

7. I, [ex-husband], authorize my children, [child(s) names], to immigrate to the United States with their mother, under a petition filed by [husband - USC].

8. This consent includes the ability for [child(s) names] to travel outside of United States with [me] and [uSC} going forward.

08-03-2017 Daughter and I completed biometrics; May 2018 - I had to redo my biometrics (reason unknown)

WAC17283xxxxx....and we wait...400 days

07-13-2018 I-551 extension stamp (12 mths) obtained at USCIS office in Detroit

09-20-2018 Transferred to TSC

10-15-2018 Text notification "New Card Being Produced"   YAY!!

luckily a friend of mine is a family lawyer and with her help (yay free) this is what we've drafted for my ex to sign.... it's also based off another post I believe I found here a while back.......

now the letter I carry with me when we're crossing the border for just a visit is much shorter and just something to the effect that he is aware and gives his consent for me to travel with the girls......
