I 797 Approval Notice Valid from 11/15/07 to 03/14/07

Timeline

My wife was approved for her K3 VISA and the Interview was ok'ed and approved on 01/23/07 and after making all of her final arrangements for departing her country; employment resignation, closing bank accounts, credit accounts, lease agreements, etc., we made flight reservations for 03/16/07. Everything was going so smoothly, then I happened to be going back through all the various I 797's we have received and I noticed that the I 797 for the USCIS Approval of the I129F K3 VISA says that it is only valid from 11/15/07 to 03/14/07. The Embassy did not say anything to her about having to make her entry by a certain date. We were thinking she had at least a few months to get her affairs in order before having to make her point of entry.

Does anyone know whether she will have a problem trying to enter two days after the valid dates on this form? Is there a way to extend the dates a few days to a week or two. We could reschedule her flight at a hefty cost, but we would rather not as there are other factors besides just the cost of rescheduling her flight.

I have already called NVC and was referred to USCIS and USCIS acted as if they were not sure about this situation and the lady said to default to the dates of the petition approval to be safe.

Any thoughts, suggestions or ideas?

Doesn't the visa itself have a date on it?

Your wife shouldn't have to show anything other than the visa - and consulates routinely extend the NOA2's anyway - the date on the NOA2 isn't the validity of the visa, but the validity of the NOA2 itself.

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

Thanks Riblet, you are probably right. I panicked when I saw the NOA2 and I haven't seen her VISA, so I do not know what iss on it exactly. I will have her look at it tonight when she gets home.
