I have heard/read unconfirmed rumours that the FBI name checks may take longer if one has a commonly used name or if one is from a few select countries?? Is this true? Is it also true that they r not making interview appointments for pple who r still pending FBI name checks??

People are still being interviewed even though the checks aren't done.

DHS claims no countries are being targeted for these checks.

The more common your surname the more likely you are to have a 'name hit'. But they also run derivatives of your entire name and phonetic matches of your surname so that can cause 'hits' as well.

It is not the 'commonness' of your name or your 'nationality' that determines how long a check will take. It is the fact that hits have to be manually researched and the growing backlog that lengthens the delay.

Well, I have extremely common names (both married and maiden name) and our name check was done fairly fast.

So like Rebecca said, that's not necessarily a ticket for a long wait.

Good luck, hope it will be resolved soon!

*requirement* is very fluid in the USCIS.

joking aside, 120 days is just a guideline based on statistics from what I can see. They use it for visas, AOS and naturalization. but its not a rule.

That's for naturalization. And I don't think it's a 'rule'. I think it's in the CFR that if the applicant requests an expedite and it's been more than 120 days, they have to complete the process. But if I understand it properly there is no real 'rule'.

There is nothing at present in the CFR to allow such relief for adjustees.

Under public comment at the moment is a reinterpretation of the 120 day rule under which all requests to expedite could be disallowed as a matter of national security.
