Well, my answer got answered... I don't know why they did not let us know before if anything was missing again.

I have no idea what it could be.. I cannot be an other 3 months without work and without being able to travel for probably an other year to go see my parents who are sick. I'm officially so done with all this BS ... !

I just received an e-mail for a new RFE for my I-485, will I need to wait an other 90days (again) for the EAD? :crying:

I highly doubt it since the EAD and AoS are separate from each other so I doubt your wait is back to 90 days, unless the RFE indicated you are missing something for your EAD then it shouldn't affect it

May 18th -- sent concurrent filings(i-485, i-130, and i-765)

May 20th -- USCIS received package

May 23rd -- NOA for biometrics set for June 8th

June 8th -- Did Biometrics had some problems getting in but was resolve

July 10th -- EAD was approved online

July 22nd -- EAD is Recieved

still waiting for Interview schedule for AoS and wating for confirmation of i-130 and i-485

I highly doubt it since the EAD and AoS are separate from each other so I doubt your wait is back to 90 days, unless the RFE indicated you are missing something for your EAD then it shouldn't affect it

USCIS confirmed it... everything is stopped until they received the Initial Evidence.

I informed the senator's office as well and asked them if there is anything they can do for the EAD.. I'm waiting on an answer.

I will be M.I.A for the next couple of days, this really hit me hard. I don't think I can handle an other 3 or more months without work. I tried to set up an infopass to find out now what the missing evidence is but the local office doesn't have any appointments available.

USCIS confirmed it... everything is stopped until they received the Initial Evidence.

I requested EAD because of an AOS therefore it is linked and despite being treated separately, there is no EAD without AOS. It makes no sense why they would need Initial Evidence because 3 months ago I had a request for Further Evidence. They should have sent it all at once...

I informed the senator's office as well and asked them if there is anything they can do for the EAD.. I'm waiting on an answer.

Yes, unfortunately technically the 90 days start over and the EAD is stopped until the RFE response is received.

Ours was day 103 from filing to EAD approval and 55 days from RFE received by USCIS, so they say 90 days starts over but chances are good that the approval will come under the 90 days.

Remember you can use a job offer to expedite the EAD.

My advice is to first do a service request at day 75 and 90 (either from first filing or after RFE received)

Then involve a senator for an inquiry.

Request an expedite with documented evidence either by yourself or with a senator.

Praying you all will get good news very soon ...... even though we have our EAD, I still feel your pain and frustration as if it was mine. (F)

They will tell you 30 days but you can try sooner just to see if something is updated. Always ask for tier 2.

So, the senator's office answered me, the Request for Initial Evidence is for the joint sponsor's birth certificate.

I had put a copy of it in my file, as well as for the K1 visa file (which they should have too), I have asked the joint sponsor for his long form birth certificate, which will be ordered.

Also, I have an other job interview, they MIGHT write me a letter which could expedite my EAD.

I would send that in after I receive the NOA that they started working on my case again.

Do you know if I get my EAD expedited thanks to this letter.

Would I HAVE to take that job or could I take an other job? It is a commission based job and at the moment I would prefer a job with at least minimum wage.

So, the senator's office answered me, the Request for Initial Evidence is for the joint sponsor's birth certificate.

I had put a copy of it in my file, as well as for the K1 visa file (which they should have too), I have asked the joint sponsor for his long form birth certificate, which will be ordered.

Also, I have an other job interview, they MIGHT write me a letter which could expedite my EAD.

Well, it is supposed to expedite the EAD because of a job offer from a particular job. I would feel a bit uncomfortable to expedite with one job offer

and then accept another but haven't read anything about someone having to give account for that. It's not really being honest.

If done without intent to change jobs and something better just happens to come along that week then I guess it would be ok. ;)
