Hi everybody

We are having some issues here and I wonder if you could help us out

My I-94 expired on Jan 13 and my K-1 visa is expiring today... We already got married and are on the AOS process...

Thing is.. seems that we can't do much in this country without one or another...what am I ? I llegal because I don't have a valid visa/I-94 anymore nor a Green Card ???

I have heard one can extend the validity of a I-94... is it possible ? and would it do any good ?

With the K-1 Visa, as long as you married within 90 days of entering the U.S., and apply for AOS (and/or EAD/AP if wanted), it's just a waiting game now.

You cannot travel outside of the U.S. until you either have AP (if applied for) or the GC.

Good luck for a speedy approval of your AOS.

Thanks... that all I know...

My question is... what documents could I have to prove that I am here legally.... like, I went to open a bank account and the woman there told me that I couldn't because my visa expires today... I had my AOS letter but she won't accept it... she said I need a green card...

Then we went to check someplaces to move and it says my I-94 needs to be valid.. I mean.. heeeeeeeeeeelllpp... I am a lil lost here... seems like I don't exist because all that I had is expired now :cry:

When are you planning on filing AOS? I have seen others post that their I-94 had expired before they filed and didn't have any problem with AOS but I wouldn't let that go on for too long. Good luck!

Try Bank of America, they will open an account for you. I know what you mean about being stuck in limbo status, my hubby can't get driver's license until he receives his greencard they will not accept anything else.

You are legally in the US, because you applied for AOS. You can use your NOA1 to prove it, if necessary.

The expiration date on your visa becomes irrelevant once you enter the US.

My wife's I-94 expires Feb.18. At what point, if ever, does the passport get a stamp or any other express statement is given that she is not in the US illegally. We applied Jamuary 21 for AOS and EAD. Is there a USCIS rule we can refer to in order to ease the process of getting things done like drivers licenses, public school ESOL programs, leases, etc.

You don't get any such statement until you either get a Green Card or a Green Card stamp in your passport.

However, NOA1 for I-485 is often considered proof of legal presence, at least it is under the REAL ID act.

We got same situation, but mine is already Expired not just Expired VERY expired! :lol: .... Im already here in USA for 1 year 6 months... WE haven't apply for AOS yet but for sure We will apply this year... Before I was concern about having my papers Expired then I call the USCIS office they told me us long I dont go out here in the US with out apply its ok! I can apply anytime Im ready! so dont worry, but its better to apply early so you dont need to do the medical again here in US... coz i do need to do that again thats wat they say! coz its been a year... GOod luck to all of us here!

March 2005- Interview in USA EMBASSY in Philippine

April2005 - Waiting for my Police clearance from JApan

May 2005- submit the Police clearance in US EMbassy

June2005 - Waiting for my approval result

June 28 2005- Visa on hand!

July 13 2005- Arrive in USA

June -July 2007- have a notice from USCIS that may interview will be soon..

Aug 2007-- Re-schedule My interview..

sept 2007-- waiting for the new schedule for interview!

Oct.2007-- my son turn 1 year old...

Nov 2007-- I got the schedule for my interview.. so excited

Dec 17 2007- FINALLY the interview ...

Dec 21 2007.card production ordered

Dec 26 2007-Notice E-mailed welcoming the new permanent resident

Jan.2 2008- Approval notice been sent.

Jan 20 2008- Recieve the (10years) GREEN CARD on the mail! FINALLY!
