Expired I-94, but waiting on AOS

Hi everyone,

To put it in simple terms... My wife came here with a K1-Visa, got married, filled for AOS, got biometrics done, but her I-94 is expired. I understand she is ok to be here while waiting to be adjusted to GC holder, however, we are not sure how to identify her status in terms of a drivers license/ID card, etc. We were able to get a state ID card but it was a limited time card as it expired on the same date as did the I-94. My question, how do we identify her legally as she will need to be entered in the department of defense as a spouse/dependent? We also have her SSN.

Any help is greatly appreciated.

You will probably have to wait until her green card is approved.

For drivers license, the requirements change from state to state, here in Florida as soon as I get the work permit (EAD) I can apply for a license. It will last as long as the permit, which is one year, same permit can be renew 120 days before it's expiration for free if your green card hasn't been approved yet.

Did you only file for AOS or also AP & EAD?

Also if her SSN is with her maiden name, you can take the EAD as a proof of legal status and change her name.

The EAD As well as AP take at the most 90 days to be produced

Her status is "applicant for adjustment of status," or, more concisely, "adjustment applicant." This came from an immigration attorney whom I consulted when I had the same question.

Go back to get a new state ID once you have the EAD/AP card in married name. The ID might be temporary again and expire when the EAD does, or you can wait for the green card.
