Fiancee - technically when from USCIS perspective?

I just want to know if some one has some idea on this subject.

From USCIS perspective, when are you considered a fiancee (or fiance)?

After a personal meeting?

After a personal meeting and exchange or a ring?

Even prior to personal meeting if there is evidence that there is some relationship?

What exactly is the definition?

when do you consider YOURSELF to have technically become engaged for marriage?

your answer is what you should focus on.

if you discussed and agreed to marriage and later boucght a ring, just state that in the application.

if you disuccsed and agreed to marriage, and then later met in person, just state taht in the application.

What Is a “Fiancé(e)”?

A fiancé(e) is a person who is engaged or contracted to be married. The marriage must be legally possible according to laws of the state in the United States where the marriage will take place.

In general, the two people must have met in person within the past two years. The Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) grants some exceptions to this requirement. For example, it may be contrary in some traditions for a man and woman to meet before marriage.

Sometimes the USCIS considers a person a "fiancé(e)" even though a marriage contract has been concluded. In such cases, the American citizen petitioner and his/her spouse have not met, and they have not consummated the marriage.

I don't know, but I've been wondering the same thing. If you aren't officially engaged (no proposal, no ring) but are planning to get married and will get officially engaged later, are you engaged from the USCIS perspective if you've sent in your I-129F? Does it make a difference to US customs officials at this stage if you refer to your SO as your boyfriend or your fiance at the POE on a trip to visit your SO?

I believe that once you apply for the fiance(e) visa you're engaged - ring or no ring.

Do you agree?

I bet that's what USCIS thinks too - seeing as K1 is a fiance(e) visa. :thumbs:

I believe that it is a matter of your interpretation. Obviously, if you had an official engagement ceremony, there is very little to interpret ;)

At POE, declaring that you are visiting your fiance is generally considered to be a risk factor. Be prepared to prove that you are coming back. Actually "boyfriend" is not exactly safe either.

What exactly is the definition?

You need to show that you have indeed met in person. There are only exeptions for people who have religious or cultural customs that would prohibit them from meeting in person before the wedding. (and I hear those are pretty rare)

I never mentioned on my application the conditions we got engaged. We just had to demonstrate a relationship. I haven't received an approval yet, but I'm confident that won't be an issue as my fiance and I are currently living together.

Every one does the engagement thing differently, and there is no way USCIS (or any one else) can mandate how that happens. For example, after my boyfriend moved in he started casually talking about marriage...after I stopped hyperventilating from anxiety a couple months later, I joined in the conversation. There was no kneeling down, heck there still isn't a ring (we are saving our pennies for the move to the states).

Good luck to you, but I would definatly plan on spending time together before you file the forms. I can't remember where the thread is, but there was a list member who was denied because they had only visited their intended once and the embassy didn't find it valid.

I dont quite understand what you mention here - how can meeting the fiance be a risk fastor? If you are coming here on K-1 visa to meet and "MARRY" the fiance, then what is the need to show that you will be coming back?????

I was replying to:

This question implies a visit with a tourist visa/VWP. In such a case it is best to avoid giving any impression that you might have any reason to stay. Obviously, do not lie.... but do not volunteer this information either. "Vacation" has always worked for me when they asked me about the reason for my trip.

OTOH, when entering the US with a K-1 visa, the intent to marry will be obvious, and denying it may lead to serious complications.
