HELP - CR-1 is almost completed but is missing my 4 y/o daughter's info

Hi Everyone,

My husband filed an I130 for me last year June. He thought the I130 also included my daughter, who is 4 y/o. Yesterday we received a letter for NVC and found out that she wasn't added to the application. We are now trying to figure out what to do. We called NVC several time, each time we heard conflicting info. one rep told us to write to ASK NVC and request that she is added to the application. Anotrher rep said that will not work and we need to complete an I130 for her and just pause on my case. Then another rep said that I can wait for my interview and have her added at that time. Can someone clarify what is correct and what to do?

My case is CR-1, It was not my husband's intent to omit my daughter from the form. He had attached all her information such as her birth certificate, copy of her passport, and two photos, when sending my documents believing that my daughter was also attached to the application.

He needs to file another I-130 for the daughter, so she can get a CR-2.

He should include a letter requesting expedite, citing your case number.

Your daughter needs a separate petition, there are no derivative beneficiaries for this category. Your case can be paused at the NVC until the petition for your daughter catches up.

Do my husband need to submit evidence showing a bonafide relationship with my daughter? Also, Is there an expedite form and what is the cost?

• No form for expedite, the request has to be made over the phone. Instructions will then be given on what to do next. Approval of the request is discretionary.
• No cost to request an expedite. No cost if the request is approved.

Also hold off doing anything else with the NVC. If you've already sent everything you can request them not to book and interview until your daughter's case catches up.

ok thank you. Also, If we apply for the I130 and can hopefully have it expedite do you think we may be able to get an interview by September. I was accepted in a degree program and I also want my daughter to start school. what do you think?
