I am planning on moving to the USA with my wife, who I am sponsoring. We currently live in Russia and are applying at the embassy in Moscow. We already had our i130's approved and are preparing our her visa interview. My question is related to the I-864 paperwork, specifically the questions related to tax returns. I have not filed taxes in two years because I did not earn enough money to be required to do so. I am attempting to file my back taxes (for the sake of covering all my bases, not because I would actually owe any money) but this process will not be complete in time for me to put this information on the form. As for qualifying financially, I am using assests rather than income, since the former meets the threshold stated in the paperwork.

My question is : am I crazy to assume that she will be approved for the visa with the above information on the paperwork? Basically, I want to ask how big a problem my lack of tax returns are going to be. And since I am not currently working in the US (though I am domiciled there officially) I do not have any US based income to qualify, which they might also see as a problem.
